for the purpose of allowing the Senate Foreign Relations Committee to file the reported joint resolution to authorize the limited and specified use of the United States Armed Forces against Syria.

Pursuant to the authority provided by section 2 of S.Con.Res.22, the Majority Leader will convene the Senate at 12:00 noon on Friday, September 6, for the purpose of allowing the Senate Foreign Relations Committee to file the reported joint resolution to authorize the limited and specified use of the United States Armed Forces against Syria. This will be a very short session with no other business conducted. This action will allow for a motion to proceed to the joint resolution to be in order on Monday.

Following Friday’s session, the Senate will convene at 2:00pm on Monday, September 9. Senator Reid intends to move to proceed to the joint resolution on Syria soon after we convene on Monday.

At 5:00pm, the Senate will proceed to Executive Session to consider the following nominations, with 30 minutes for debate equally divided and controlled between Senators Leahy and Grassley, or their designees:

– Valerie E. Caproni, of New York, to be a United States District Judge for the Southern District of New York; and

– Vernon S. Broderick, of New York, to be a United States District Judge for the Southern District of New York.

Upon the use or yielding back of time (approximately 5:30pm), the Senate will proceed to vote in relation to the above nominations. We expect one of the nominations to be considered by voice vote.

12:05:33 P.M.		The House received a communication from Representative Alexander wherein he will resign as a member of the House of Representatives effective September 27, 2013.
12:05:54 P.M.		The House received a communication from Teresa Lewis, Constituent Services Liason. Pursuant to Rule VIII of the Rules of the House of Representatives, Ms. Lewis notified the House that she had been served with a third-party subpoena, issued by the Hamilton County Municipal Court, Hamilton County, Ohio for documents and testimony in a criminal case. After consultation with the Office of General Counsel, she had determined that compliance with the subpoena was consistent with the precedents and privileges of the House.

The Senate stands in adjournment until 9:30am on Thursday, August 1, 2013.

Following any Leader remarks, the Senate will be in a period of morning business until 11:00am with the time equally divided and controlled between the two Leaders or their designees with Senators permitted to speak therein for up to 10 minutes each.
At 11:00am, the Senate will proceed to Executive Session to consider Executive Calendar #96, the nomination of Raymond T. Chen, of Maryland, to be United States Circuit Judge for the Federal Circuit with up to one hour of debate equally divided and controlled in the usual form. Upon the use or yielding back of time (at approximately 12:00pm), there will be a roll call vote on confirmation of the Chen nomination.
Upon disposition of the Chen nomination, the Senate will resume legislative session and proceed to a roll call vote on the motion to invoke cloture on S.1243, the Transportation, Housing and Urban Development and related agencies appropriations bill.
The filing deadline for all 2^nd degree amendment to S.1243 is 11:00am on Thursday.
Following the cloture vote, the Senate will recess until 2:00pm to allow for a bipartisan caucus meeting.
At 2:00pm, the Senate will proceed to Executive Session to consider Executive Calendar #220, the nomination of Samantha Power, of Massachusetts, to be the Representative of the United States of America to the United Nations, with the rank and status of Ambassador Extraordinary and Plenipotentiary and the Representative of the United States of America in the Security Council of the United Nations with up to 2 hours of debate equally divided and controlled in the usual form. Senator Reid then moved to proceed to Calendar #154, S.1392, a bill to promote energy savings in residential buildings and industry (Shaheen-Portman).

The Senate adopted S.Con.Res.22, a resolution that provides for a conditional adjournment or recess of the Senate and House of Representatives. Under the provisions of the resolution, there would be a pro forma session at 12:00 noon on Monday, August 12. The House would have to adopt the concurrent resolution in order to the Senate to recess for the month of August, with the mid-month pro forma.

Senator Durbin asked unanimous consent the Senate proceed to the consideration of Calendar #33, H.Con.Res.25; the amendment at the desk, which is the text of S.Con.Res.8, the budget resolution passed by the Senate, be inserted in lieu thereof; and that H.Con.Res.25, as amended, be agreed to. Further, that the Senate insist on its amendment, request a conference with the House on the disagreeing votes of the two Houses; and the Chair be authorized to appoint conferees on the part of the Senate; and that following the authorization, two motions to instruct conferees be in order from each side:

– Motion to instruct relative to the debt limit; and

– Motion to instruct relative to taxes/revenue;

That there be two hours of debate equally divided between the two Leaders, or their designees, prior to votes in relation to the motions; further, that no amendments be in order to either of the motions prior to the votes; all of the above occurring with no intervening action or debate.

Senator Rubio asked that the request be modified so that it not be in order for the Senate to consider a conference report that includes reconciliation instructions to raise the debt limit. Senator Durbin objected to Senator Rubio’s modification. Senator Rubio objected to the original request.

Senator McConnell asked unanimous consent to pass Calendar #145, H.R.2668, To delay the application of the individual health insurance mandate, to delay the application of the employer health insurance mandate, and for other purposes.

Senator Reid moved to proceed to Calendar #99, S.1243, the Transportation, and Housing and Urban Development (THUD) Appropriations bill. The motion to proceed is a debatable motion and we will work with senators on an agreement to adopt the motion early next week.

The Senate is in a period of morning business for 1 hour, with senators permitted to speak therein for up to 10 minutes each. The Majority controls the first 30 minutes and the Republicans control the final 30 minutes.

Following morning business, the Senate will resume Executive session to consider Executive Calendar #99, the nomination of Thomas Perez, of Maryland, to be Secretary of Labor, post-cloture. We would like to vote on confirmation of the Perez nomination and cloture on the McCarthy nomination this morning and on confirmation of the McCarthy nomination early after the lunches. We will continue to work with the Republicans on an agreement to set those votes. Senators will be notified when the votes are scheduled.

Senator Reid also announced that there is also an agreement among Senators Harkin, Durbin, King, Manchin, Alexander, Coburn and Burr on the student loan interest rate legislation. We will work with senators on a path forward that could result in a couple votes. I suspect the process of reaching an agreement for floor consideration will take a bit of time and it would slip into next week, but Senator Reid has said he would like to consider it as soon as possible.

By consent, the vote on confirmation of the Perez nomination will occur at 12:15pm today. Following disposition of the Perez nomination, the time until 2:30pm will be equally divided in the usual form prior to the cloture vote on the McCarthy nomination. If cloture is invoked on McCarthy, there would be up to 8 hours for debate prior to a vote on confirmation. However, we hope to be able to yield a good portion of that time back.
