The Senate stands in adjournment until 9:30am on Thursday, September 12, 2013. Following any Leader remarks, there will be a period of morning business for one hour with the Majority controlling the first half and the Republicans controlling the final half.

Following morning business, the Senate will resume consideration of S.1392, the Energy Savings and Industrial Competitiveness Act.

Senator Vitter proposed two unanimous consent requests and Senator Wyden objected to both.

Request to call up several amendments and vote on Vitter amendment and side-by-side

Senator Vitter asked unanimous consent that the amendments listed below be made pending:

That on Tuesday, September 17, at a time to be determined jointly by the Majority and Minority Leaders, there be 60 minutes for debate equally divided between Senators Wyden and Vitter. That the only amendment in order to the Vitter amendment be one offered by the Majority Leader or his designee, both subject to debate under the time limit on the Vitter amendment. That no points of order be in order to these two amendments. That upon the expiration of the debate time the Senate proceed to vote on the Vitter amendment and any pending amendments, with the amendment and any amendments to it be subject to a 60-vote threshold to be agreed to.

Senator Wyden objected.

Senator Vitter later said he would add Blumenthal amendment #1878 (commercial building energy code study) to the list.

Request to vote on Vitter bill with no amendments in order

Senator Vitter asked unanimous consent to withdraw the Vitter amendment #1866 (this doesn’t make sense because the amendment isn’t pending) and that on Wednesday, September 25 at 3:00pm, the Senate discharge the relevant committees from consideration of his bill (didn’t specify bill number), the no exemption for Washington from Obamacare Act, and proceed to consideration of that bill, and that without any intervening motions or debate, the Senate proceed to 60 minutes of debate on that bill, evenly divided and controlled by the Majority Leader and Senator Vitter, and that the bill not be subject to any amendments or motions to commit, and that after debate has expired, the bill be read a third time, and the Senate immediately vote on final passage, and that the motion to reconsider be made and laid upon the table.

Senator Wyden objected.

Senator Franken asked unanimous consent to call up  Franken amendment #1855 (energy information for commercial buildings).

Senator Vitter objected.

Senator Sanders asked unanimous consent to set aside the pending amendment in order to call up Sanders amendment #1915 (State residential building energy efficiency upgrades loan pilot program).

Senator Vitter reserved his right to object and asked unanimous consent that the amendments listed below be made pending:

Senator Gillibrand asked consent to set aside the pending amendment in order to call up Gillibrand amendment #1860 (disaster relief/emergency assistance for energy efficiency products). Senator Vitter also objected to calling up her amendment and asked consent to call up a series of amendments, and vote on his health care amendment and an alternative. Senator Wyden objected to his request. He then  asked the same consent he’s asked several times today to vote on his bill with no amendments in order. Senator Wyden objected to this request. Finally, Senator Vitter objected to Gillibrand’s original request.

The Senate is in a period of morning business with senators permitted to speak therein for up to 10 minutes each.

The Senate stands in adjournment until 10:00am on Wednesday, September 11, 2013.  Following the prayer and the pledge, there will be a moment of silence to pay tribute to the thousands of Americans whose lives were taken on September 11, 2001.

 Following any Leader remarks, the time until 2:30pm will be equally divided and controlled between the two Leaders or their designees with Senators permitted to speak therein for up to 10 minutes each.

 There will be a bipartisan, bicameral remembrance ceremony of the 12th anniversary of the September 11th attacks at 11:00am tomorrow on the East Front of the Capitol.

Members will gather in the rotunda at 10:45am.

The Senate is in a period of morning business for debate only until 2:30pm, with the time equally divided and controlled between the two Leaders or their designees and Senators permitted to speak therein for up to 10 minutes each.

As a reminder, there is an order to adopt the motion to proceed to S.1392, Energy Savings and Industrial Competitiveness Act of 2013, at a time to be determined by the Majority Leader, with the concurrence of the Republican Leader. Discussions continue on the appropriate time to turn to its consideration.

The Senate has adopted the motion to proceed to S.1392, Energy Savings and Industrial Competitiveness Act of 2013. By consent, no amendments or motions relative to Syria or the use of military force are in order during the consideration of the bill. The time until 6:00pm is equally divided between the two Leaders, or their designees. There will be a period for debate only to allow for opening statements on the bill (Wyden 20 minutes, Murkowski 20 minutes, Shaheen 15 minutes and Portman 15 minutes). Senators will be notified if and when any votes are scheduled.

The following amendments are pending to S.1392, Energy Savings and Industrial Competitiveness Act of 2013 :

The Merkley amendment #1858 (standby power usage study) is pending

Senator Inhofe asked unanimous consent to set aside the pending amendment in order to consider Inhofe-Carper amendment #1851 (to modify the federal purchase of renewable energy requirement). Senator Vitter objected. Senator Vitter wants an agreement to vote on his healthcare amendment before any other amendments are considered.

 Senator Udall (CO) spoke about an amendment on energy retrofitting of schools that he would like to call up but will refrain from offering until there is no objection to setting aside the pending amendment.

Senator Bennet asked consent to call up amendment #1847 (commercial real estate landlords and tenants). Senator Vitter objected.

Senator Klobuchar asked consent to set aside the pending amendment in order to call up Klobuchar amendment #1856 (retrofitting nonprofit buildings). Senator Portman objected on behalf of Senator Vitter.

The Senate is in a period of morning business until 7pm with senators permitted to speak therein for up to 10 minutes each. We expect to resume consideration of the energy efficiency bill tomorrow morning.

The Senate will convene at 2:00pm on Monday, September 9, 2013.

At 5:00pm, the Senate will proceed to Executive Session to consider the following items:

–          Executive Calendar #184 Valerie E. Caproni – to be United States District Judge for the Southern District of New York and

–          Executive Calendar #185 Vernon S. Broderick – to be United States District Judge for the Southern District of New York.

There will be up to 30 minutes of debate on the nomination equally divided and controlled in the usual form.  Upon the use or yielding back of time (at approximately 5:30pm), the Senate will proceed to vote on confirmation of the nominations.  Only roll call vote is expected Monday evening; one of the nominations is expected to be confirmed by voice vote.

5:34pm the Senate began a 15 minute roll call vote on confirmation of Executive Calendar #184, Valerie E. Caproni, of New York, to be a United States District Judge for the Southern District of New York.

Confirmed: 73-24

The Broderick nomination was confirmed by voice vote. The Senate is now in a period of morning business with senators permitted to speak therein for up to 10 minutes each. There will be no further roll call votes tonight.

Senate stands in adjournment until 10:00am on Tuesday, September 10, 2013.

  Following any Leader remarks, the Senate will be in morning business until 11:00am with the time equally divided and controlled between the two Leaders or their designees with Senators permitted to speak therein for up to 10 minutes each.

At 11:00am, the Senate will resume the motion to proceed to Legislative Calendar #166, S.J.Res.21, to authorize the limited and specified use of the United States Armed Forces against Syria.  The time until 12:00pm will be equally divided Senators will be permitted to speak for up to 10 minutes each.

The Senate will recess from 12:00pm until 2:15pm to allow for the weekly caucus meetings.

After the Senate convened today, Senator Reid renewed the motion to proceed to S.J.Res.21, to authorize limited use of the Armed Forces against Syria.

 There was a previous order that the Senate proceed to the consideration of S.1392, the Energy Efficiency bill sponsored by Senators Shaheen and Portman, at 11am today. By consent, the order was modified that the motion to proceed be agreed to at a time to be determined by the Majority Leader with the concurrence of the Republican Leader.

Under the previous order, the Senate will be in a period of morning business until 11:00am, with the time equally divided between the two Leaders or their designees.

The Senate will continue to debate the motion to proceed to the Syria resolution today. The Senate will recess from 12:00 noon until 2:15pm to allow for the weekly caucus meetings.

By unanimous consent the Senate confirmed Executive Calendar #191, the nomination of Georgia, Marilyn A. Brown, to be a Member of the Board of Directors of the Tennessee Valley Authority for a term expiring May 18, 2017 (Reappointment).

 The Senate is now debating the motion to proceed to S.J.Res.21, Syria, with the time until 12:00 noon equally divided between the two Leaders or their designees.

Pursuant to the authority provided by section 2 of S.Con.Res.22, the Majority Leader will convene the Senate at 12:00 noon on Friday, September 6, for the purpose of allowing the Senate Foreign Relations Committee to file the reported joint resolution to authorize the limited and specified use of the United States Armed Forces against Syria. This will be a very short session with no other business conducted. This action will allow for a motion to proceed to the joint resolution to be in order on Monday.

Following Friday’s session, the Senate will convene at 2:00pm on Monday, September 9. Senator Reid intends to move to proceed to the joint resolution on Syria soon after we convene on Monday.

At 5:00pm, the Senate will proceed to Executive Session to consider the following nominations, with 30 minutes for debate equally divided and controlled between Senators Leahy and Grassley, or their designees:

–       Valerie E. Caproni, of New York, to be a United States District Judge for the Southern District of New York; and

–       Vernon S. Broderick, of New York, to be a United States District Judge for the Southern District of New York.

 

Upon the use or yielding back of time (approximately 5:30pm), the Senate will proceed to vote in relation to the above nominations. We expect one of the nominations to be considered by voice vote.
