CONGRESS: the Republican led House – the Senate considers S.3187,the FDA user fees


the Senate Convenes: 10:00amET May 22, 2012

  • Following the prayer and pledge, the Majority Leader will be recognized. It is his intention to resume consideration of the motion to proceed to Calendar #400, S.3187, the FDA user fees legislation.
  • Following the remarks of the Majority Leader and the Republican Leader, the first hour will be equally divided and controlled between the two sides with the Majority controlling the first half and the Republicans controlling the final half.
  • The Senate will recess from 12:30pm until 2:15pm to allow for the weekly caucus meetings.
  • At 2:15pm, the motion to proceed to S.3187 will be adopted, the Harkin-Enzi substitute amendment will be agreed to and considered original text for the purposes of further amendment. The Majority Leader will then be recognized. Senators will be notified when votes are scheduled.

12:15pm Senator Vitter asked unanimous consent that the Senate take up and pass S.577, a bill to eliminate the child tax credit for U.S. citizen children of immigrant parents. Senator Reid objected.

2:30pm The previous order to adopt the motion to proceed S.3187, the FDA bill, at 2:15pm has been delayed until 4pm, with all other provisions under the previous order remaining in effect at that time.

4:13pm By consent, Senator Reid has delayed the execution of the order to adopt the motion to proceed to S.3187, the FDA bill, until 11:00am tomorrow, Wednesday, May 23.

There will be no roll call votes during Tuesday’s session of the Senate.

the Senate Convenes: 2:00pmET  May 21, 2012

  • Following the prayer and pledge, the Majority Leader will be recognized.  It is his intention to resume consideration of the motion to proceed to Legislative Calendar #400, S.3187, the FDA user fees legislation.
  • At 4:30pm, the Senate will proceed to Executive Session to consider Executive Calendar #552, the nomination of Paul J. Watford, of California, to be a United States Circuit Judge for the 9th Circuit with up to one hour for debate equally divided and controlled between Senators Leahy and Grassley or their designees.  Upon the use or yielding back of time (at approximately 5:30p), the Senate will conduct a roll call vote on the motion to invoke cloture on the Watford nomination.
  • If cloture is not invoked, the Senate will resume Legislative Session and conduct a 2nd roll call vote on the motion to invoke cloture on the motion to proceed to Legislative Calendar #400, S.3187, the FDA user fees legislation.

When the Senate convened, Senator Reid renewed his motion to proceed to S.3187, the FDA bill.

By consent, cloture on the Watford nomination was vitiated. Under the previous order, at 4:30pm there will be one hour for debate and the Senate will then vote on confirmation of the nomination.

At 5:30pm today the Senate will proceed to a roll call vote on confirmation of Executive Calendar #552, the nomination of Paul J. Watford, of California, to be United States Circuit Judge for the Ninth Circuit.

Upon disposition of the nomination, the Senate will proceed to vote on the motion to invoke cloture on the motion to proceed to S.3187, the FDA bill.

By consent, cloture on the motion to proceed to S.3187, the FDA bill, was vitiated. At 2:15pm tomorrow, Tuesday, May 22, the motion to proceed will be adopted and the Harkin-Enzi substitute amendment will be agreed to and considered original text for the purposes of further amendment. The Majority Leader will then be recognized.

5:27pm The Senate began a roll call vote on confirmation of Executive Calendar #552, the nomination of Paul J. Watford, of California, to be United States Circuit Judge for the Ninth Circuit; Confirmed: 61-34

There will be no further roll call votes during Monday’s session of the Senate.

Following the vote, the Senate discharged the Foreign Relations Committee from further consideration of H.R.1905, Iran Threat Reduction Act, and the Senate proceeded to its consideration.

The Johnson(SD)-Shelby substitute amendment #2123, which is the text of Calendar #320, S.2101, the Iran Sanctions, Accountability, and Human Rights Act, as reported by the Banking Committee, was amended by the Johnson(SD)-Shelby amendment #2124, and then the substitute, as amended, was agreed to.

The Senate then passed H.R.1905, as amended, by voice vote.

  • It is the Majority Leader’s intention to begin consideration of the motion to proceed Calendar #400, S.3187, the FDA user fees bill with the time until 10:30am equally divided and controlled between the two Leaders or their designees with the Republicans controlling the first half and the Majority controlling the final half.
  • At 10:30am, the Senate will proceed to Executive Session to consider the following items:
  • Executive Calendar #646, Jeremy C. Stein, of Massachusetts, to be a Member of the Board of Governors of the Federal Reserve System for the unexpired term of fourteen years from February 1, 2004 and

  • Following the prayer and pledge, the Majority Leader will be recognized.
  • It is the Majority Leader’s intention to resume consideration of the motion to proceed to H.R.2072, the Export-Import Bank Reauthorization Act with the first hour equally divided and controlled between the two Leaders or their designees with the Majority controlling the first half and the Republicans controlling the final half.
  • At 11:15am, the motion to proceed to H.R.2072 will be adopted and the Senate will begin consideration of the bill. The only first degree amendments in order to the bill are the following:
  • Lee amendment #2100 (phase-out);
  • Paul amendment #2101 (limitation on Ex-Im support);
  • Corker amendment #2102 (export credit agencies);
  • Vitter amendment #2103 (energy development); and
  • Toomey amendment #2104 ($40 billion increase contingency).
  • There will be up to two hours of debate to run concurrently on the amendments and the bill, equally divided, between the two Leaders, or their designees, prior to votes in relation to the amendments in the order listed above. Upon disposition of the amendments, the Senate will vote on passage of the bill, as amended, if amended. There will be two minutes equally divided prior to each vote; and all after the first vote be ten minute votes. The amendments and passage of the bill are subject to a 60 affirmative vote threshold.   • It is the Majority Leader’s intention to resume consideration of the motion to proceed to H.R.2072, the Export-Import Bank Reauthorization Act on Monday. As a reminder to all Senators, cloture was filed on the motion to proceed to H.R.2072 during Friday’s session.
  • At 4:30pm, the Senate will proceed to Executive Session to consider the following items:

5:43pm The Senate has reached an agreement to consider H.R.2072, Export-Import Bank Reauthorization. As a result, we were able to vitiate tonight’s cloture vote. The first judge in the series, George Levi Russell (Maryland) was confirmed by voice vote. The Senate is now voting on confirmation of the Tharp nomination (Illinois).

The agreement on Ex-Im is as follows:

At 11:15am, Tuesday, May 15th, the Senate will adopt the motion to proceed to Calendar #396, H.R.2072, an Act to reauthorize the Export-Import Bank of the United States. The only first degree amendments in order to the bill are the following:

– Lee #2100;

– Paul #2101;

– Corker #2102;

– Vitter #2103; and

– Toomey #2104.

No amendments are in order to any of the amendments prior to the votes. No motions or points of order are in order other than budget points of order and the applicable motions to waive. There will be up to two hours of debate to run concurrently on the amendments and the bill, equally divided, between the two Leaders, or their designees, prior to votes in relation to the amendments in the order listed. Upon disposition of the amendments, the Senate will proceed to vote on passage of the bill, as amended, if amended. There will be two minutes equally divided prior to each vote; and all after the first vote be ten minute votes. The amendments and passage of the bill are subject to a 60 affirmative vote threshold.
