Congress…  empty on so many levels

The Senate stands in adjournment until 9:30am on Tuesday, October 1, 2013.

Following the prayer and pledge, the Majority Leader will be recognized.  If the Senate receives a message from the House, the Majority Leader announced he will move to table the message tomorrow morning at 9:30am.

The Senate will recess from 12:30pm until 2:15pm to allow for the weekly caucus meetings

Shortly after the Senate convenes and the Senate receives the House Message on H.J.Res.59, the continuing resolution, the Senate will immediately consider the House Message and Senator Reid will move to table the House Message. The House Message which would delay Obamacare for 1 year and request a conference on the joint resolution. Senators should expect the vote to begin around 9:35am.

At 9:33am the Senate began a 15 minute roll call vote on Reid motion to table the House Message on H.R.59, the continuing resolution. The House Message would delay Obamacare for 1 year and request a conference on the joint resolution;

10:06am The House Message on H.J.Res.59 (1-year Obamacare delay and request for conference) was tabled 54-46. The continuing resolution will now go back to the House for its consideration.

The Senate is in a period of morning business for debate only until 12:30pm with the time equally divided and controlled between the two leaders or their designees, with senators permitted to speak therein for up to 10 minutes each. After the Senate convenes at 2pm, Senator Reid intends to ask the chair to lay before the Senate the Message on H.J.Res.59, the continuing resolution, and move to table the House Amendments to the Senate amendment to H.J.Res.59. As a result, senators should expect a roll call vote to begin shortly after 2pm today

By unanimous consent, the Senate passed S.1560, a bill to allow certain emergency relief amounts made available to the Federal Highway Administration to be used for disasters occurring in calendar year 2013.

By unanimous consent, the Senate passed H.R.3210, a bill making continuing appropriations for military pay in the event of a Government shutdown.

7:45pm If the House passes the continuing resolution with an amendment and sends the papers to the Senate tonight, Senator Reid intends to move to table the House Amendment this evening. We could vote in the 9pm range, but of course that depends on House action. Senators will be notified of the timing of the next vote as the situation unfolds.

9:06pm The Senate began a 15 minute roll call vote on the Reid motion to table the House Amendment to the Senate Amendment to H.J.Res.59, the continuing resolution. The House Amendment provides a one-year delay in the Affordable Care Act individual mandate; requires Members of Congress, congressional staff, and political appointees (including White House staff) to enroll in the Obamacare exchanges without an employer subsidy for coverage; amends the expiration date of the CR to be December 15, 2013;

9:41pm The Senate tabled the House Amendment to the Senate Amendment to H.J.Res.59 by a vote of 54-46. The joint resolution now goes back to the House. If the House sends us another unfriendly amendment there could be vote to table the House Amendment tonight.

 Meanwhile, the Senate is in a period of morning business for debate only until 11:00pm.

 Senators will be notified when the next vote is expected.

11:03pm The period for morning business for debate only has been extended until 12:00 midnight.

11:30pm By unanimous consent, the Senate passed S.1566:, a bill to extend the period during which Iraqis who were employed by the United States Government in Iraq may be granted special immigrant status.

It is now after midnight and the federal government is shutdown. It appears the House will not pass a clean continuing resolution tonight and will instead request to go to conference on the continuing resolution. If the Senate receives a message from the House to go to conference, Senator Reid will move to table the request at approximately 9:30am later today, Tuesday, October 1. After a few brief statements, the Senate will adjourn until 9:30am.

The Senate stands in adjournment until 10:00am on Thursday, September 26, 2013. Following any Leader remarks, the Senate will resume consideration of H.J.Res.59. the Continuing Resolution, with the time from 10:30am controlled in 1 hour increments, with the Majority controlling the first hour and alternating thereafter.

If no agreement is reached under Rule 22, the cloture vote on the Continuing Resolution would occur 1 hour after the Senate convenes on Friday. The filing deadline for germane first degree amendments to H.J.Res.59, is 1:00pm tomorrow.

Yesterday Senator Reid filed cloture on the H.J.Res.59, the continuing resolution. If cloture is invoked, germane first degree amendments must be filed at the desk prior to 1:00pm today to be considered in order, if cloture is invoked.

If no agreement can be reached, the cloture vote on the joint resolution would occur one hour after the Senate convenes tomorrow, Friday, September 27. However, by consent the vote could be moved to another time, perhaps even later today. Senators will be notified when any votes are scheduled.

Senator Vitter asked unanimous consent to set aside the pending amendment to call up Vitter amendment #1983, to prohibit funds for congressional and certain administration officials’ health insurance contributions.

Senator Tester objected.

Senator Toomey asked unanimous consent to set aside the pending amendment in order to call up the following amendments:

Toomey #1971 (repeal medical devise excise tax)

Toomey #1972 (delay application of individual health insurance mandate)
