SCHEDULE FOR THURSDAY, JUNE 27, 2013

The Senate stands in adjournment until 9:30am on Thursday, June 27, 2013, as a further mark of respect of the late Senator Hathaway of Maine.  Following any Leader remarks, the Senate will resume consideration of S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act, with the time until 11:30am equally divided and controlled between the two Managers or their designees, and with senators permitted to speak therein for up to 10 minutes each.

 At 11:30am, there will be 3 roll call votes:

–          Confirmation of Confirmation of Executive Calendar #179, the nomination of Anthony Renard Foxx, of North Carolina, to be Secretary of Transportation

–          Adoption of the committee-reported substitute amendment, as amended to S.744 and

–          Motion to invoke cloture on S.744, as amended, if amended.

If cloture is invoked on S.744, post-cloture time will run as if cloture were invoked at 7:00am on Thursday.  We hope to yield back some post-cloture debate time and vote on passage of the Comprehensive Immigration Reform bill Thursday afternoon.

At 11:30am there will be 3 roll call votes on the following items:

–          Confirmation of Executive Calendar #179, the nomination of Anthony Renard Foxx, of North Carolina, to be Secretary of Transportation (majority vote threshold);

–          Adoption of the committee-reported substitute amendment, as amended to S.744 (majority vote threshold); and

–          Motion to invoke cloture on S.744, as amended, if amended, the Comprehensive Immigration Reform bill (60-vote threshold).

If cloture is invoked on S.744, the 30 hours of post-cloture time will run as if cloture were invoked at 7:00am this morning. If all time is used, the post-cloture time would expire at 1pm tomorrow; however, we hope to obtain consent to yield back time and vote on passage today.

In his opening statement this morning, Senator Reid asked that senators vote from their desks on passage of the bill, whether the vote be tomorrow or later today. Senator Reid said that if senators are not on the floor prior to the vote we would have a live quorum in order to get people to the floor. Senators will be notified when the vote is scheduled.

Senator McConnell then asked consent that the Senate proceed to the consideration of a bill introduced earlier today by Senators Manchin, King, Alexander, Coburn, Burr, and Carper (S.1241), that there be 1 hour for debate equally divided, with no amendments in order, the bill be subject to any applicable points of order, and that following the use or yielding back of time and disposition of any waivers if necessary, the bill be read a third time and the Senate proceed to vote on passage of the bill.

Obama Launches DNC Campaign Tour At Illinois State Capitol

The Senate stands in adjournment until 10:00am on Tuesday, June 25, 2013.

  • Following any Leader remarks, the Senate will be in a period of morning business for one hour with the Majority controlling the first half and the Republicans controlling the final half.
  • Following morning business, the Senate will resume consideration of S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act.  The Senate will consider the Leahy amendment #1183, as modified, post-cloture.
  • During Monday’s session of the Senate, cloture was filed on the committee-reported substitute amendment and S.744.  As a result, the filing deadline for first degree amendments to both the committee-reported substitute and S.744 is 12:00pm on Tuesday.
  • All time during adjournment, recess, morning business and Executive Session will count post-cloture on the Leahy amendment #1183, as modified (with the Corker-Hoeven language regarding border security).

Notwithstanding Rule XXII, at 2:15pm today, the Senate will proceed to Executive Session to consider Executive Calendar #180, the nomination of Penny Pritzker, to be Secretary of Commerce. Senator Vitter made a point of order that the bill would violate the Senate pay-go rule. Senator Leahy moved to waive all points of order with respect to the bill and pending amendments.

Senators are still working on a potential agreement to consider amendments to the bill, however, additional votes today seem to be unlikely.

The filing deadline for all 2nd degree amendments to the committee-reported substitute and S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act is 10:30am Wednesday. Germane second degree amendments to the committee-reported substitute amendment and the

underlying bill must be filed at the desk prior to the deadline to be considered in order post-cloture.

As a reminder, last week Senator Reid filed cloture on the Leahy amendment #1183, as modified. That cloture vote will occur at 5:30pm today. If cloture is invoked there would be up to 30 hours for debate prior to a vote on adoption of the Leahy amendment, as modified (late Tuesday night/early Wednesday morning if all time is sued).

The filing deadline for second degree amendments to Leahy amendment #1183, as modified, is 4:00pm today. If your senator has a germane second degree amendment, please send a signed copy of the amendment to the cloakroom prior to the deadline so that we may file it at the desk for you.

Today Senator Reid filed cloture on the committee-reported substitute amendment to S.744, the Comprehensive Immigration Reform bill, and the underlying bill. Under the rule, the filing deadline for 1st degree amendments to the committee reported substitute, as amended, is 1:00pm tomorrow, Tuesday, June 25. Barring any further agreement, the cloture vote on the committee reported substitute amendment, as amended, would occur 1 hour after the Senate convenes Wednesday. If cloture is invoked on the substitute, there would be an additional 30 hours for debate prior to a vote on adoption of the substitute. Upon disposition of the substitute, the Senate would then proceed to vote on the motion to invoke cloture on the underlying bill, as amended. There would then be another 30 hours of post-cloture debate.

The Senate stands in adjournment until 10:30am on Friday, June 21, 2013.

  • Following any Leader remarks, the Senate will resume consideration of S.744, the Border Security, Economic Opportunity, and Immigration Modernization Act and the Majority Leader will be recognized at that time.
  • Negotiations with respect to the Immigration bill continue.  Senators will be notified if and when an agreement is reached.
  • The Senate has resumed consideration of S.744, the Comprehensive Immigration Reform bill. The time until 2:30pm is for debate only, with the time equally divided and controlled between the two Leaders, or their designees, and with senators permitted to speak therein for up to 10 minutes each. Senator Sessions will control up to 2 hours.We are working on a couple unresolved issues to a border security amendment. We hope we can resolve those issues quickly so that we are able to find a path forward on the bill.
  • After much hard work and negotiations, we have made significant progress on S.744, the Comprehensive Immigration reform bill.Senator Leahy modified amendment #1183, with the text of a perfecting substitute amendment that includes negotiated border security language. Senator Reid then offered a technical amendment in the second degree slot and filed cloture on Leahy amendment #1183, as modified. By consent, the cloture vote on the Leahy amendment #1183, as modified, will occur at 5:30pm on Monday, June 24.

    Senator Reid also filled the underlying bill side of the amendment tree and entered a motion to recommit the bill with instructions and filled that portion of the amendment tree with technical amendments.

    The Senate will vote on Monday evening on the motion to invoke cloture on the Leahy border security amendment. We’ll continue to work to get an agreement to help process amendments. But, barring any further agreement the Senate will vote on cloture on the committee-substitute early Wednesday and cloture on the bill on Thursday. We’ll finish the bill before the recess.

  • The filing deadline for second degree amendments to Leahy amendment #1183, as modified, is 4:00pm on Monday, June 24.
  • At a time to be determined by the Majority Leader, in consultation with the Republican Leader, the Senate will proceed to Executive Session to consider Executive Calendar #180, the nomination of Penny Pritzker, of Illinois, to be Secretary of Commerce. There will be 30 minutes for debate equally divided in the usual form. Following the use or yielding back of time, the Senate will proceed to vote without intervening action or debate on the nomination.
  • At a time to be determined by the Majority Leader, in consultation with the Republican Leader, the Senate will proceed to Executive Session to consider Executive Calendar #179, the nomination of Anthony Renard Foxx, of North Carolina, to be Secretary of Transportation. There will be 30 minutes for debate equally divided in the usual form. Following the use or yielding back of time, the Senate will proceed to vote without intervening action or debate on the nomination.
