The Senate reached an agreement to place on the Calendar of Business H.R.933, a bill making appropriations for the Department of Defense, the Department of Veterans Affairs, and other departments and agencies for the fiscal year ending September 30, 2013, and for other purposes. We expect to consider the bill next week.

At 5:00pm on Monday, March 11, the Senate will proceed to Executive Session to consider the following nominations:

– Executive Calendar #9 Richard Gary Taranto, of Maryland, to be United States Circuit Judge for the Federal Circuit; and

– Executive Calendar #17 Andrew Patrick Gordon, of Nevada, to be United States District Judge for the District of Nevada.

There will be up to 30 minutes of debate equally divided and controlled between Senators Leahy and Grassley or their designees on the nominations. The Senate stands in adjournment until 10:00am on Tuesday, March 5, 2013.

Following any Leader remarks, the Senate will be in morning business until 11:45am with time equally divided and controlled between the two Leaders or their designees with the Majority controlling the first 30 minutes and the Republicans controlling the second 30 minutes.
Following morning business, the Senate will begin consideration of S.Res.64, an original resolution authorizing expenditures by committees of the Senate for the period March 1, 2013, through September 30, 2013.
The only amendment in order to the resolution is a Paul amendment, striking provisions relative to the National Security Working Group with up to 30 minutes of debate equally divided and controlled.
Upon the use or yielding back of time (at approximately 12:15pm), there will be a roll call vote on adoption of the Paul amendment. Upon the disposition of the Paul amendment, the Senate will vote on adoption of S.Res.64, as amended, if amendment (expected voice vote).
The Senate will recess from 12:30pm until 2:15pm to allow for the weekly caucus meetings.
During Monday’s session, cloture was filed on Executive Calendar #13, the nomination of Caitlin Joan Halligan, of New York, to be United States Circuit Judge for the District of Columbia Circuit. Under the rule, the cloture vote will be on Wednesday morning.

Following any Leader remarks, the Senate will be in morning business for one hour with the Majority controlling the first 30 minutes and the Republicans controlling the second 30 minutes.
The nomination of Jacob Lew to be Treasury Secretary was reported out of the Finance committee on Tuesday. We hope to reach an agreement to consider the Lew nomination on Wednesday.
Also during Tuesday’s session, cloture was filed on the motion to proceed to S.388, the American Family Economic Protection Act (introduced by Senators Mikulski, Murray and Reid). Under the rule, that cloture vote will occur on Thursday.

The Senate has turned to Executive Session to consider Executive Calendar #26, the nomination of Jacob Lew, of
New York, to be Secretary of the Treasury. There will now be up to 8 hours for
debate equally divided between the two Leaders or their designees. Upon the use
or yielding back of time, the Senate will proceed to vote on confirmation of the
nomination.

There will now be 10 minutes for debate prior to a vote on confirmation of the
Lew nomination. If all times is used, the vote would begin at approximately

Following any Leader remarks, the Senate will resume Executive Session and the consideration of Executive Calendar #10, the nomination of Charles Timothy Hagel, of Nebraska, to be Secretary of Defense.
During Wednesday’s session of the Senate, cloture was filed on the Hagel nomination.

The cloture vote is expected on Friday, February 15, 2013

The Senate has reached an agreement to have the cloture vote on the Hagel nomination at 4:15pm today.

The time until 4:15pm will be equally divided and controlled between the two Leaders or their designees. At 4:15pm, the Senate will proceed to a roll call vote on the motion to invoke cloture on Executive Calendar #10, the nomination of Charles Timothy Hagel, of Nebraska, to be Secretary of Defense.

Cloture on the Hagel nomination failed 58-40, 1 voting present (Hatch). The vote would have been 59-39, 1-present, but for procedural reasons Senator Reid changed his vote to no in order to enter the motion to reconsider.

Senators should expect to reconsider the failed cloture vote to occur Tuesday morning, February 26, and a vote on a judge around 5:30pm on Monday, February 25.

There will be no further roll call votes this week.

The Senate has reached an agreement to consider the Bacharach nomination.

At 5:00pm on Monday, February 25, the Senate will turn to Executive Session to consider the nomination of Robert E. Bacharach, of Oklahoma, to be United States Circuit Judge for the Tenth Circuit, with the time until 5:30pm equally divided and controlled between the two Leaders or their designees. At 5:30pm, the Senate will proceed to a roll call vote on confirmation of the Bacharach nomination.

The Senate reached an agreement that on either Monday, February 25^th or Tuesday, February 26^th, the Majority Leader and the Republican Leader each be permitted to introduce a bill to replace the sequester required under the Budget Control Act. Further, if a Leader introduces such legislation, his bill would be placed directly on the Legislative Calendar. Finally, motions to proceed to these bills would be in order the day they are introduced.
