3/20/13 — H.R.933, the Department of Defense, Military Construction and Veterans Affairs, and Full-Year Continuing Appropriations Act, 2013, as amended; Passed: 73-26

The Senate stands in adjournment until 9:00am on Thursday, March 21, 2013.

Following the prayer and pledge, the Senate will resume consideration of S.Con.Res.8, a concurrent resolution setting forth the congressional budget for the United States Government for fiscal year 2014, revising the appropriate budgetary levels for fiscal year 2013, and setting forth the appropriate budgetary levels for fiscal years 2015 through 2023.
When the Senate convenes on Thursday, there will be 34 hours remaining for debate on the budget resolution, equally divided and controlled between the Chair and Ranking Member of the Budget Committee.

The Senate has resumed consideration of S.Con.Res.8, the Budget resolution. Senator Reid reiterated his intention that the Senate will be in session until we complete the Budget resolution and that could mean being in session all night Friday night or whatever it takes. Senators should plan accordingly.

Senator Sessions made a motion to recommit S.Con.Res.8 back to the Committee on the Budget with instructions to report back no later than March 22, 2013 with such changes as may be necessary to achieve unified budget balance by Fiscal Year 2023.

Motions to recommit are debatable for up to 1 hour, equally divided, and are amendable in two degrees. Each amendment to a motion is debatable for 1 hour each and equally divided. It would take consent to return to the resolution side of the amendment tree to offer amendments to the resolution.

When a vote time is set, another message will be sent.

At 3:45pm today, there will be up to 60 minutes of debate equally divided between Senators Klobuchar and Coats, or their designees, for a report on the economic goals and policy under section 305(b) of the Congressional Budget Act.

We believe to be close to locking in an agreement that would result in a series of up to 5 roll call votes in the 8pm range tonight. When an agreement is reached and vote time is set, I will send another message.

During Tuesday’s session, cloture was filed on the motion to proceed to H.R.933, the continuing appropriations bill. If no agreement is reached, the cloture vote will be Thursday morning

The Senate adopted the motion to proceed H.R.933, Department of Defense, Military Construction and Veterans Affairs, and Full-Year Continuing Appropriations Act, 2013.

Senator Reid then called up Mikulski-Shelby amendment #26, as modified (substitute). The substitute is the text of The Consolidated and Further Continuing Appropriations Act of 2013, which includes separate divisions for the Fiscal Year 2013 Agriculture; Commerce, Justice and Science; Defense; Homeland Security; and Military Construction and Veterans Affairs Appropriations Acts.

We are in a period for debate only until the managers of the bill come to the floor, around 10:30am.

We expect the first amendments to the bill to be offered by Senator Cruz (Affordable Care Act funding) and Senator Harkin (Labor-HHS).

Senator Cruz called up amendment #30, which prohibits funds for the Affordable Care Act. The managers are talking about an appropriate time to vote in relation to the amendment, could be around the noon hour. Senators will be notified when a vote time is set or expected.

The following amendments are pending to H.R.933, the continuing appropriations bill:

Upon disposition of the Cruz amendment, the next amendment in order is a Harkin amendment relative to Labor-HHS Appropriations.

Votes are possible in relation to the Harkin amendment #53 (Labor-HHS) and McCain amendment #33 (strikes certain DoD Operation and Maintenance grants to Guam) in the not too distant future. Another message will be sent if and when an agreement is reached.

The time until 5:30pm will be equally divided and controlled between Senators McCain and Durbin, or their designees. At 5:30pm, the Senate will proceed to vote in relation to the McCain amendment #33.

The McCain amendment #33 strikes $13 million for construction of a regional public health laboratory and $106.4 million for civilian water and wastewater improvements in Guam through the Office of Economic Adjustment; and strikes the Department of Defense authority to make grants, conclude cooperative agreements, and supplement other Federal funds.

The McCain amendment #33 was not tabled 48-50 and was then adopted by voice vote.

Senator Boxer reserved her right to set aside the pending amendment unless Senator Inhofe would be willing to agree to a 60 vote threshold. Senator Inhofe agreed and the amendment was called up.

The Senate stands in adjournment until 10:00am on Tuesday, March 12, 2013.

Following any Leader remarks, the Senate will be in a period of morning business until 12:30pm with the time equally divided and controlled between the two Leaders or their designees with the Majority controlling the first 30 minutes and the Republicans controlling the second 30 minutes.
The Senate will recess from 12:30pm until 2:30pm to allow for the weekly caucus meetings.
Chairwoman Mikulski and Ranking Member Shelby are expected to make their opening statements around 11:00am on H.R.933, the continuing appropriations bill.
We expect to begin consideration of the bill following the recess for the caucus meetings.

Prior to the caucus recess, Senator Reid moved to proceed to H.R.933, Department of Defense, Military Construction and Veterans Affairs, and Full-Year Continuing Appropriations Act, 2013.

We expect to adopt the motion to proceed this afternoon. Once we begin consideration of the bill, Senator Mikulski plans to offer a substitute amendment that includes separate divisions for the Fiscal Year 2013 Agriculture; Commerce, Justice and Science; Defense; Homeland Security; and Military Construction and Veterans Affairs Appropriations Acts.

The Senate stands in recess until 2:30pm.

We have been unable to reach an agreement to begin consideration of H.R.933, Department of Defense, Military Construction and Veterans Affairs, and Full-Year Continuing Appropriations Act, 2013. As a result of this impasse, Senator Reid filed cloture on the motion. We will continue to work to adopt the motion to proceed tomorrow. If we are unable to adopt the motion, the cloture vote would occur one hour after the Senate convenes on Thursday.

The Senate is in a period of morning business with senators permitted to speak therein for up to 10 minutes each. There will be no roll call votes tonight.

The Chair announced the Speaker’s policies with respect to particular aspects of the legislative process and inserted in the Congressional Record announcements concerning: first, privileges of the floor; second, introduction of bills and resolutions; third, unanimous-consent requests for the consideration of legislation; fourth, recognition for 1-minute speeches; fifth, recognition for special-order speeches; sixth, decorum in debate; seventh, conduct of votes by electronic device; eighth, use of handouts on the House floor; ninth, use of electronic equipment on the House floor; and tenth, use of the Chamber. The Chair further announced that these announcements will reiterate the origins of the stated policies and that the Chair intends to continue in the 113th Congress the policies reflected in those statements and that the policy announced in the 102nd Congress with respect to jurisdictional concepts
5:15:08 P.M.		The House received a message from the Clerk. Under clause 2(g) of rule II of the Rules of the House of Representatives, the Clerk notified the House that she had designated Robert Reeves, Deputy Clerk, and Kirk D. Boyle, Legal Counsel, to sign any and all papers and do all other acts for her under the name of the Clerk of the House that they would be authorized to do by virtue of this designation, except such as are provided by statute, in case of her temporary absence or disability. This designation shall remain in effect for the 113th Congress or until modified by the Clerk.
5:15:32 P.M.		The House received a communication from The Honorable John A. Boehner, Speaker. Pursuant to H. Con. Res. 1, and also for purposes of such concurrent resolutions of the current Congress as may contemplate my designation of Members to act in similar circumstances, the Speaker notified the Clerk of his designation of Representative Eric Cantor of Virginia to act jointly with the Majority Leader of the Senate or his designee, in the event of his death or inability, to notify the Members of the House and the Senate, respectively, or any reassembly under any such concurrent resolution. In the event of the death or inability of that designee, alternate Members of the House are listed in the letter from the Speaker bearing the date of January 3, 2012 for the same purposes.
5:16:35 P.M.		The Chair announced that the Speaker has delivered to the Clerk a letter dated January 3, 2013, listing Members in the order in which each shall act as Speaker pro tempore under clause 8(b)(3) of rule I.
5:17:01 P.M.		SPEAKER PRO TEMPORE – the Speaker appointed the Honorable Jeff Denham, the Honorable Mac Thornberry, the Honorable Fred Upton, the Honorable Andy Harris, and the Honorable Frank R. Wolf to act as Speaker pro tempore to sign enrolled bills and joint resolutions through the remainder of the One Hundred Thirteenth Congress.

5:17:32 P.M.	H. Res. 1	Subsequent to the adoption of the resolution, the Chair announced that, without objection, H. Res. 1 is amended by striking “Florida” in the second place it appears and inserting “Oregon”.
