The Senate is considering S.1867, the Department of Defense Authorization bill.

Senator McConnell has called up amendment #1084 (Iran Sanctions). By consent, the next amendment offered will be by Senators Levin and McCain and the Levin-McCain amendment will be considered as being the first amendment offered.

The Levin-McCain amendment #1092 (counterfeit electronic parts) is pending to S.1867, the DoD Authorization Act. The Ayotte amendment #1065 (force structure for strategic airlift aircraft) was agreed to by unanimous consent.

5:30PM  The Senate is now debating the conference report to accompany H.R.2112, the Agriculture, CJS and Transportation Appropriations bill, which includes the continuing resolution momentarily. There will be up to two hours of debate equally divided and controlled between the two Leaders or their designees. However, we expect to yield back some debate time and vote as early as 7:00pm. The conference report will be subject to a 60-vote threshold.

Additionally, the Leahy amendment #1072 (National Guard), the Paul amendment #1064 (repeal the Military Force against Iraq Authorization Resolution) and the Merkley amendment #1174 (Afghanistan) were made pending to S.1867, the DoD Authorization Act prior to turning to the conference report to accompany H.R.2112.

  • Following the prayer and pledge, there will be a period of morning business until 11am, with Senators permitted to speak therein for up to 10 minutes each. The Majority will control the first half and the Republicans will control the next half.
  • At 11am, the Senate will proceed to Executive Session to consider the nominations of Sharon Gleason, to be U.S. District Judge for the District of Alaska, and Yvonne Rogers, to be U.S. District Judge for the district of Northern California. There will be 1 hour for debate prior to votes on confirmation of the nominations. Therefore, senators should expect a series of 2 roll call votes to begin at noon.
  • Following the votes, the Senate will recess until 2:15pm to allow for the weekly caucus meetings.

When the Senate resumed consideration of HR 2354, the Energy and Water appropriations bill, Senator Reid withdrew the committee reported substitute amendment. He then offered a new substitute amendment #956, which included the text of Energy and Water, Financial Services/General Government; and State/Foreign Operations appropriations. Senator Menendez raised a Rule 16 point of order that was well taken and the amendment fell.

Senator Reid then offered a new substitute (Reid amendment #957), which includes the 3 appropriations bills minus the offending Cuba related language.

The Divisions of the Reid substitute amendment #957 are as follows:

Division A: text of the withdrawn committee-reported amendment (Energy and Water appropriations)

Division B: text of Calendar #171, S.1573 with the exception of sections 620 and 624 (Financial Services/General Government appropriations minus the offending Cuba language)

Division C: text of Calendar #179, S.1601 (State/Foreign Operations appropriations)

Senator Reid then asked consent that HR 2434, as reported by the House Appropriations Committee and Division C of amendment #957 be deemed House passed text in HR 2354 for purpose of Rule 16 and that amendment #957 for the purposes of paragraph 1 Rule 16 be considered a committee amendment. In English, that means Senator Reid was seeking consent to use the following bills for defense of germaneness purposes: HR 2354 (Energy and Water), HR 2434 (Financial Services), S.1601 (State/Foreign Operations).

Senator Moran objected to Senator Reid’s request and Senator Vitter also spoke in opposition to the request.

News broke yesterday of a very bad idea.

Sixty Democrats in the House signed a letter to the so-called “Super Committee” saying that Medicare benefit cuts are on the table — essentially giving the Super Committee a green light to slash Medicare in pursuit of its goal of $4 trillion in budget cuts.

These Democrats have thrown up their hands and quit on one of the most important fights right now for the middle class. Worst of all, some of them are progressives we’ve relied on in the past.

Medicare is not the problem. Medicare did not cause the run-up in federal deficits. Republican tax-cuts to the richest 1% and their corporate friends caused the mess we’re in. Those people should be the ones to clean up the mess, not middle class families and seniors that are struggling to get by.

If Democrats give in to Republicans on Medicare, they will be doing so at the expense of so many middle class families that are counting on them right now to protect their benefits in this difficult time.

Congress: the Republican led House the Senate in pro forma Session


The Senate will convene on Monday, October 24, 2011 at 3:45pm and on Thursday, October 27, 2011 at 11am for pro forma sessions only with no business conducted.

Following the pro forma session on Thursday, October 27th, the Senate will adjourn until 3:00pm on Monday, October 31, 2011.  Following any Leader remarks, the Senate will be in morning business until 4:30pm with Senators permitted to speak therein for up to 10 minutes each.

Following morning business, the Senate will proceed to Executive Session to consider Calendar #249, Stephen A. Higginson, of LA, to be United States Circuit Judge for the 5th Circuit with one hour equally divided and controlled between Senators Leahy and Grassley or their designees.

The next roll call vote will be at approximately 5:30pm on confirmation of the Higginson nomination.
