The Senate stands in adjournment until 12:00 noon on Wednesday,

October 16, 2013.  Following any Leader remarks, Senators will be permitted to speak for up 10 minutes each.

During the opening, Senate Reid renewed the motion to proceed to S.1569, a bill to ensure the complete and timely payment of the obligations of the United States Government until December 31, 2014.

The Senate has reached an agreement to consider the Debt Limit/CR and to go to conference on the Budget resolution. There will be a series of 2 roll call votes beginning momentarily.

By consent, the Senate will now begin consideration of H.R.2775, agree to the substitute amendment, which is the text of the debt limit and CR deal, and immediately proceed to a cloture vote on the bill, as amended. If cloture is invoked, the Senate would immediately proceed to vote on passage of the bill, as amended.

The Senate also agreed that if the senate passes H.R.2775, as amended, the Senate go to conference on the Budget resolution and authorized the Chair to appoint conferees with a ratio of 12 Democrats and 10 Republicans. The conferees are instructed to report back a conference report by December 13, 2013. It is not in order for the Senate to consider a conference report if it includes reconciliation instructions to raise the debt limit. If the House fails to concur in the Senate amendment to H.R.2775 (Debt Limit/CR), the agreement to go to conference on the Budget would be vitiated.

Agreement to go to conference on Budget resolution

Murray:           I ask unanimous consent that if the Senate passes H.R.2775, as amended, the Senate then proceed to the consideration of Calendar #33, H.Con.Res.25; that the amendment at the desk, which is the text of S.Con.Res.8, the budget resolution passed by the Senate, be agreed to and the motion to reconsider be considered made and laid upon the table; that H.Con.Res.25, as amended, be agreed to; the motion to reconsider be considered made and laid upon the table; that the motion for the Senate to insist on its amendment, be agreed to; that the Senate request a conference with the House on the disagreeing votes of the two Houses and authorize the Chair to appoint conferees on the part of the Senate, with a ratio of 12 Democrats and 10 Republicans; that the conferees be instructed to report back a conference report by December 13, 2013; that if the Senate receives from the House a request to go to conference on S.Con.Res.8, that this agreement be modified so that the Senate agree to the request to go conference on S.Con.Res.8, with the remaining provisions related to the conference remaining in effect; further, that it not be in order for the Senate to consider a conference report with respect to H.Con.Res.25 or S.Con.Res.8, if it includes reconciliation instructions to raise the debt limit; and that all of the above occur with no intervening action or debate; finally, that H.Con.Res.25, as amended, and passed, be held at the desk until a message is received from the House relative to H.R.2775 and if the House fails to concur in the Senate amendment to H.R.2775, this agreement be vitiated.

Agreement on CR/Debt Limit

Reid:                I ask unanimous consent the Senate proceed to the consideration of Calendar #193, H.R.2775; that the substitute amendment, which is at the desk, be agreed to (text of debt limit until February 7, 2014 and CR through January 15, 2014); that a cloture motion on the bill, as amended, which is at the desk, then be read; that the mandatory quorum required under rule 22 be waived; that no other amendments, points of order or motions be in order to the bill; that if cloture is invoked, all post-cloture time be yielded back and the bill, as amended, be read a third time and the Senate proceed to vote on passage of the bill, as amended; that if the bill, as amended, is passed, that a title amendment, which is at the desk be agreed to; finally, that if cloture is not invoked, the action above with respect to the amendment to the bill be vitiated and the bill be returned to the calendar.

The Senate stands adjourned under the provisions of S.Res.267 as a further mark of respect to the memory of the late Senator Rod Grams of Minnesota until 10:30am on Thursday, October 10, 2013.

  Following any Leader remarks, it is expected that the Majority Leader will move to proceed to S.1569, a bill to ensure the complete and timely payment of the obligations of the United States Government until December 31, 2014.

The time until 1:00pm will be equally divided and controlled between the two Leaders or their designees.

At 1:00pm, the Senate will recess subject to the call of the Chair to allow for special caucus meeting with the President.

This morning Senator Reid moved to proceed to Calendar #211, S.1569, a bill to ensure the complete and timely payment of the obligations of the United States Government until December 31, 2014. The time until 1:00pm is equally divided between the two Leaders or their designees. As a reminder, the Senate will recess at 1:00pm subject to the call of the Chair.

By unanimous consent, the Senate passed H.J.Res.91, Making continuing appropriations for death gratuities and related survivor benefits for survivors of deceased military service members of the Department of Defense for fiscal year 2014.

Senator Murray asked unanimous consent that when the Senate receives a Message from the House that they have passed H.J.Res.59, as amended by the Senate, the Senate go to conference on the Budget resolution (H.Con.Res.25, as amended with the text of S.Con.Res.8).

Senator Cornyn reserved his right to object, questioned why the Democratic offer requires the House to pass the clean continuing resolution (to open the government), and asked that the request be modified to prohibit the Senate from considering the conference report if it includes reconciliation instructions to increase the debt limit. Senator Murray objected to the modification. Senator Cornyn objected to the original request.

The period of morning business for debate only has been extended until 5pm. The Republicans control the time between 2-2:45pm and the Majority controls the time from 2:45-3:30pm.

Several Republican senators asked unanimous consent that the Senate take up and pass mini-continuing resolutions and a sense of Congress regarding religious services to members of the Armed Forces. In most cases, there was a Democratic counteroffer to amend the applicable legislative vehicle with a clean CR amendment. After counteroffers and counter-counteroffers, there was eventually an objection to each request.

Senator McConnell asked unanimous consent to take up and adopt H.Con.Res.58, expressing the sense of Congress regarding the need for the continued availability of religious services to members of the Armed Forces and their families during a lapse in appropriations. Senator Casey asked for a modification to the request include an amendment on the sense of Congress that the House should vote on clean the CR, Senator McConnell objected to the modification, and Senator Casey objected to original request)

Senator Cornyn asked unanimous consent that after receipt from House, the Senate take up and pass H.J.Res.91, Making continuing appropriations for death gratuities and related survivor benefits for survivors of deceased military service members of the Department of Defense for fiscal year 2014. Senator Reid stated that the President is going to fix this situation shortly and asked that Senator Cornyn renew his request after 4pm. Senator Cornyn agreed and withdrew his request.

 

Senator Enzi asked unanimous consent to take up and pass H.J.Res.70, National Park Service Operations, Smithsonian Institution, National Gallery of Art, and United States Holocaust Memorial Museum Continuing Appropriations Resolution, 2014. Senator Boxer asked to modify the request to include a clean CR amendment, Senator Enzi objected to the modification, and Senator Boxer objected to the original request.

Senator Coats asked unanimous consent to take up and pass H.J.Res.85, Federal Emergency Management Agency Continuing Appropriations Resolution, 2014. Senator Durbin asked to modify the request to include a clean CR amendment. Senator Coats said would be willing to modify the request to include other emergency response agencies, but objected to Senator Durbin’s request. Senator Durbin objected to the original request.

Senator Hoeven asked unanimous consent to take up and pass H.R.3230, Making continuing appropriations during a Government shutdown to provide pay and allowances to members of the reserve components of the Armed Forces who perform inactive-duty training during such period. Senator Murray asked to modify the request to include a clean CR amendment, Senator Hoeven objected to the modification, and Senator Murray objected to the original request.

Senator Rubio asked unanimous consent to take up and pass H.J.Res.84, Making continuing appropriations for Head Start for fiscal year 2014. Senator Harkin objected.

Senator Paul asked unanimous consent to take up and pass H.J.Res.70, National Park Service Operations, Smithsonian Institution, National Gallery of Art, and United States Holocaust Memorial Museum Continuing Appropriations Resolution, 2014. The Senate stands in adjournment until 10:00am on Tuesday, March 12, 2013.

  • Following any Leader remarks, the Senate will be in a period of morning business until 12:30pm with the time equally divided and controlled between the two Leaders or their designees with the Majority controlling the first 30 minutes and the Republicans controlling the second 30 minutes.
  • The Senate will recess from 12:30pm until 2:30pm to allow for the weekly caucus meetings.
  • Chairwoman Mikulski and Ranking Member Shelby are expected to make their opening statements around 11:00am on H.R.933, the continuing appropriations bill.
  • We expect to begin consideration of the bill following the recess for the caucus meetings.

Prior to the caucus recess, Senator Reid moved to proceed to H.R.933, Department of Defense, Military Construction and Veterans Affairs, and Full-Year Continuing Appropriations Act, 2013.

We expect to adopt the motion to proceed this afternoon. Once we begin consideration of the bill, Senator Mikulski plans to offer a substitute amendment that includes separate divisions for the Fiscal Year 2013 Agriculture; Commerce, Justice and Science; Defense; Homeland Security; and Military Construction and Veterans Affairs Appropriations Acts.

The Senate stands in recess until 2:30pm.

We have been unable to reach an agreement to begin consideration of H.R.933, Department of Defense, Military Construction and Veterans Affairs, and Full-Year Continuing Appropriations Act, 2013. As a result of this impasse, Senator Reid filed cloture on the motion. We will continue to work to adopt the motion to proceed tomorrow. If we are unable to adopt the motion, the cloture vote would occur one hour after the Senate convenes on Thursday.

The Senate is in a period of morning business with senators permitted to speak therein for up to 10 minutes each. There will be no roll call votes tonight.
