the Senate Convened at 10:00amET February 14,2013

Following any Leader remarks, the Senate will resume Executive Session and the consideration of Executive Calendar #10, the nomination of Charles Timothy Hagel, of Nebraska, to be Secretary of Defense.
During Wednesday’s session of the Senate, cloture was filed on the Hagel nomination.

The cloture vote is expected on Friday, February 15, 2013

The Senate has reached an agreement to have the cloture vote on the Hagel nomination at 4:15pm today.

The time until 4:15pm will be equally divided and controlled between the two Leaders or their designees. At 4:15pm, the Senate will proceed to a roll call vote on the motion to invoke cloture on Executive Calendar #10, the nomination of Charles Timothy Hagel, of Nebraska, to be Secretary of Defense.

Cloture on the Hagel nomination failed 58-40, 1 voting present (Hatch). The vote would have been 59-39, 1-present, but for procedural reasons Senator Reid changed his vote to no in order to enter the motion to reconsider.

Senators should expect to reconsider the failed cloture vote to occur Tuesday morning, February 26, and a vote on a judge around 5:30pm on Monday, February 25.

There will be no further roll call votes this week.

The Senate has reached an agreement to consider the Bacharach nomination.

At 5:00pm on Monday, February 25, the Senate will turn to Executive Session to consider the nomination of Robert E. Bacharach, of Oklahoma, to be United States Circuit Judge for the Tenth Circuit, with the time until 5:30pm equally divided and controlled between the two Leaders or their designees. At 5:30pm, the Senate will proceed to a roll call vote on confirmation of the Bacharach nomination.

The Senate reached an agreement that on either Monday, February 25^th or Tuesday, February 26^th, the Majority Leader and the Republican Leader each be permitted to introduce a bill to replace the sequester required under the Budget Control Act. Further, if a Leader introduces such legislation, his bill would be placed directly on the Legislative Calendar. Finally, motions to proceed to these bills would be in order the day they are introduced.

We hope to begin debate on Executive Calendar #10, the nomination of Senator Hagel to be Secretary of Defense on Wednesday.

After a conversation with Senator McConnell and Senator Inhofe, it became clear to Senator Reid that Republicans are not willing to enter into an agreement for consideration of Executive Calendar #10, the nomination of Charles Timothy Hagel, of Nebraska, to be Secretary of Defense. In order to move the process along, Senator Reid filed cloture on the nomination. Under the rule, the cloture vote would occur one hour after the Senate convenes on Friday. Senator Reid suggested on the floor that senators should plan accordingly.

Following any Leader remarks, the Senate will resume consideration of S.47, the Violence Against Women Act with the time until 11:00am equally divided and controlled between the two Leaders or their designees.
At 11:00am, there will be up to 6 roll call votes in relation to the following in the following order:

- Portman amendment #10 (sex trafficking)
- Murkowski amendment #11 (tribal protections)
- Coburn amendment #15 (consolidate DOJ rape programs)

the Senate Convenes: 10:00amET December 27,2012

Following any Leader remarks, the Senate will begin consideration of H.R.5949, FISA Reauthorization, at which point Senator Wyden will be recognized.
The next roll call vote will be at 5:30pm on Thursday, December 27^th in relation to the FISA bill or the Emergency Supplemental Appropriations bill.

The Senate has begun consideration of H.R.5949, FISA Reauthorization. Under the previous order, there will be up to 7 hours for debate on the bill and 30 minutes equally divided on each of the amendments listed below.

– Leahy (Judiciary committee reported substitute);

– Merkley (declassification of FISA court opinions);

– Paul (4^th Amendment – searches/seizures); and

– Wyden (public reporting);

Upon the use or yielding back of time, the Senate will proceed to votes in relation to the amendments in the order listed. Upon disposition of the amendments, the bill will be read a third time and the Senate will proceed to vote on passage of the bill, as amended, if amended.

In addition to the FISA extension, we could also consider amendments to the Emergency Supplemental Appropriations bill today, as provided for under a previous order. As you may recall, cloture on the Supplemental was invoked last week and we reached a further agreement to limit amendments that are in order to the Supplemental.

Senators should expect a series of votes to begin at 5:30pm tonight in relation to the FISA extension and possibly amendments to the Emergency Supplemental Appropriations bill.

Senate-designate Brian Schatz will be sworn in as senator (HI) at 2:30pm today.

At 5:30pm tonight, the Senate will proceed to a series of up to 3 roll call votes in relation to the following amendments to H.R.5949, FISA:

– Leahy #3437 (substitute);

– Merkley #3534 (declassification of FISA court opinions); and

– Paul #3436 (searches and seizures).

There will be 2 minutes for debate between each vote. All votes after the first vote will be 10 minutes in duration. When the Senate convenes tomorrow, there will be 30 minutes for debate prior to a vote in relation to the Wyden amendment (public reporting) and passage of H.R.5949, as amended, if amended. Under the previous order, the amendments and passage of the FISA bill are subject to 60 affirmative vote thresholds.

Senator Reid has asked senators with amendments to the Emergency Supplemental Appropriations bill to call up and debate their amendments tonight so that we can begin voting on the amendments tomorrow.
