The Senate stands in adjourned until 9:00am on Tuesday, December 17, 2013.

At 10:00am, there will be a roll call vote on the motion to invoke cloture on the motion to concur in the House message with respect to H.J.Res.59, the budget resolution.

 Under the rule, the filing deadline for second degree amendments to the motion to concur in the House message with respect to H.J.Res.59 is 9:00am on Tuesday.

 As a reminder to all Senators, on Sunday, December 15th, Senator Reid filed cloture on the motion to concur in the House message to accompany H.J.Res.59, the budget resolution and the motion to concur in the House message to accompany H.R.3304, the Defense Authorization bill.

The Senate will recess from 12:30 until 2:15pm to allow for the weekly caucus meetings. The time during the recess will count post-cloture on the motion to concur in the House amendment to the Senate amendment to H.J.Res.59, the Bipartisan Budget Act.

Senator Sessions asked unanimous consent to set aside the pending motion to concur with a amendment #2547 (date change) in order to make a motion to concur with Sessions amendment #2573 (the amendment would eliminate a wide variety of deficit-neutral reserve funds that could be used to facilitate future consideration of legislation that would address certain high priorities)

Senator Murray made a brief statement and objected.

Senator Sessions then made the following parliamentary inquiry: Is it correct that while the majority leader’s motion to concur in the house amendment with an amendment to which the majority leader has also offered a second degree amendment is pending, no senator is permitted to offer an amendment to the House-passed Budget bill?

Chair: the senator is correct.

Senator Sessions made a further parliamentary inquire: if a motion to table the majority leader’s motion to concur with an amendment is successful, would there be an opportunity for me to offer a motion to concur with my amendment #2573?

 Chair: that is correct

 Senator Sessions then moved to table the motion to concur with an amendment, offered by the majority leader.

At 5:24pm, the Senate began a 15 minute roll call vote on the motion to concur in the House amendment to the Senate amendment to H.J.Res.59, with amendment #2547 (date change);

Not tabled: 46-54

The Sessions motion to table the motion to concur with amendment was not agreed to 46-54. The Senate is now in a period of morning business with senators permitted to speak therein for up to 10 minutes each, with the exception of Senator Grassley for up to 20 minutes. The time will count post-cloture. There will be no further roll call votes.

By unanimous consent, the Senate passed H.R.3588, to amend the Safe Drinking Water Act to exempt fire hydrants from the prohibition on the use of lead pipes, fittings, fixtures, solder, and flux.

Senator Reid asked unanimous consent to set aside the pending Levin amendment #2123 and Senator Gillibrand or her designee be recognized to offer the amendment #2099 (sexual assault) and that the amendment be subject to a relevant side-by-side amendment from Senators McCaskill and Ayotte, amendment #2170. He also asked consent that no second degree amendments be in order and each of the amendments be subject to 60 affirmative votes; that when the Senate resumes consideration of the bill on Wednesday, November 20th, the time until 5:00pm be equally divided between the proponents and the opponents of the Gillibrand amendment; and that that at 5:00pm, the Senate proceed to vote in relation to the Gillibrand amendment #2099; that upon disposition of the Gillibrand amendment, the Senate proceed to vote in relation to the McCaskill-Ayotte amendment #2170; that there be two minutes equally divided in between the votes; and no motions to recommit be in order during the consideration of the sexual assault amendments.

Senator Inhofe asked to modify the request that following disposition of the McCaskill/Ayotte amendment #2170, all pending amendments be withdrawn and the Republican manager or his designee be recognized to offer the next amendment in order to be followed by an amendment offered by the Majority side and the two sides continue to offer amendments in alternating fashion until all amendments are disposed of.

Senator Reid did not agree to the modification and Senator Inhofe objected to the original request.

  • The time until 2:15pm will be equally divided and controlled between the two Leaders or their designees with the Republicans controlling the first 30 minutes and the Majority controlling the second 30 minutes.
  • As a reminder, cloture was filed on the motion to proceed to S.3412, the Middle Class Tax Cut on Monday, July 23rd.  By unanimous consent, at 2:15pm on Wednesday, there will be a roll call vote on the motion to invoke cloture on the motion to proceed to S.3412, the Middle Class Tax Cut Act.

As a reminder at 2:15pm today, the Senate will proceed to a roll call vote on the motion to invoke cloture on the motion to proceed to S.3412, the Middle Class Tax Cut Act.

The Senate has reached an agreement that results in a series of 2 roll call votes beginning at 4pm today on the McConnell-Hatch amendment # _____ and on passage of S.3412, as amended, if amended. Each subject to a majority vote threshold. There will be 2 minutes for debate prior to each vote. As a result of this agreement, there will be no cloture vote at 2:15pm.

Prior to locking in the agreement, Senator Reid asked consent to vote on the McConnell–Hatch amendment and Reid bill, as amended, if amended, and when the Senate receives a companion bill from the House, the Senate proceed to its immediate consideration, insert the text of S.3412, as passed by the Senate, and the Senate pass the House bill, as amended.

Senator McConnell asked consent to strike the provision to marry the Senate language with the House bill and, in lieu, vote on the McConnell-Hatch proposal, a McConnell amendment, which is his version of “ the President’s tax bill”, and the Reid bill (S.3412). Senator Reid declined to modify his request to vote on those three items because the President strongly supports the Reid bill and that is the President’s proposal.

Senator Reid then agreed to strike the provision to marry the Senate language with the House bill per McConnell’s request, and renewed his request, as modified. That request was agreed to.

McConnell-Hatch amendment (text of S.3413), to temporarily extend tax relief provisions enacted in 2001 and 2003, to provide for temporary alternative minimum tax relief, to extend increased expensing limitations, and to provide instructions for tax reform (McConnell-Hatch).

S.3412, a bill to extend the 2001, 2003 and 2009 tax cuts for 98% of Americans and 97% of all small businesses (Reid).

4:08pm The Senate began a roll call vote on Hatch-McConnell amendment #2573 (Extends 2001 and 2003 tax cuts); Not Agreed to: 45-54

4:50pm The Senate began a roll call vote on passage of S.3412, the Middle Class Tax Cut Act; Passed: 51-48

Senator Reid moved to proceed to S.3414, Cyber Security, and filed cloture on the motion. The vote would occur Friday unless an agreement can be reached.
