Why My Son Ryan Ferguson Should Be Granted A New Trial

My son Ryan Ferguson was convicted in 2005 for the 2001 murder of Columbia Daily Tribune sports editor Kent Heitholt. Ryan was convicted solely on the testimony of two witnesses. Both of those witnesses have since given written affidavits that their testimonies during the original trial were false. That leaves zero evidence against my son. No witnesses, no physical evidence, no DNA, no motive, in fact nothing tying him to the crime. Yet my son is currently serving a 40-year sentence for a crime he had no part in.

The fact is Ryan should never have been convicted in the first place, because the main witness in his case was never credible. The jury simply believed Chuck Erickson’s story.

Ryan and Chuck were Rock Bridge High School juniors who snuck into a bar on Halloween night 2001 and left sometime around 1:15 a.m. Ryan said he drove his friend Chuck home, then came home himself. He has never wavered from his account.

Years later Chuck – who is a troubled young man – told friends that he had ‘dreams’ about the murder. He said he initially repressed his memory of the killing but began to recall details two years later after reading news reports of the crime. Details emerged in his ‘dreams’, he claimed. He called the encounter a botched robbery hatched when he and Ryan ran out of money and wanted to keep drinking.

The police brought Chuck in for questioning after hearing about his stories. In the interrogation tapes – available online – it is clear that Chuck knows very little about the case and admits he doesn’t even know if he was there. But the police feed him key information about the murder and pressure him into confessing and implicating Ryan in the murder. There was never any physical evidence against either of them. My son Ryan had never been in any trouble with the law before this point and had no connection to the victim Kent Heitholt.

The second ‘witness’, janitor Jerry Trump, originally told friends he could not identify who he saw near the body. But during a 2004 trial he positively identified Ryan and my son was sentenced to spend the majority of his adult life behind bars.

Both Erickson and Trump now claim they were coerced into modifying their statements in favor of the prosecution of my son. Chuck blames Columbia Police interrogators for not delving into inconsistencies in his story, and Trump said Prosecutor Kevin Crane told him that it would be “helpful to him” if Trump could identify Ryan as one of the men at the crime scene. The prosecution also withheld key information that could have helped prove my son’s innocence, including further witnesses who state that Ryan wasn’t at the scene.

We now know that both key witnesses gave false testimonies. In light of these significant changes in eyewitness testimony and the lack of ANY evidence implicating Ryan, it is clear that my son deserves a new trial.

Ryan’s case has been covered extensively on NBC Dateline, CBS 48 Hours Mystery, and numerous TV news reports and magazine and newspaper articles. His story has touched millions of people across America – and the world. It has become clear to many people that Ryan has been betrayed by the Missouri justice system and deserves another shot at justice.

The Ryan budget is an unfair and irresponsible plan that would undermine key programs women and families count on — while giving tax breaks to the wealthy and corporations.

Action is needed now! The House of Representatives could vote as early as tomorrow on the Ryan budget. Tell your Representative to vote NO on the Ryan Budget.

Wondering if you should take action? Think about this.

Ryan’s budget would:

  • Deny millions of women and families access to affordable health insurance by repealing the Affordable Care Act.
  • Significantly cut funding for programs like child care assistance and Head Start, which help women work and children learn.
  • Undermine core safety net programs that women count on by slashing Medicaid and SNAP (food stamps) and turning them into block grants.
  • Slash funding for K-12 education, Pell Grants, job training, and domestic violence prevention.

And, to add insult to injury, Ryan’s budget would, at the same time:

6 Things Americans Did Not Vote for in 2012

Tomorrow, Rep. Paul Ryan (R-WI) will release the latest version of his infamous Republican budget plan — you know, the one that ends Medicare as we know it. As we await this plan, it’s worth considering a few things that voters did not choose in the 2012 election.

  1. Paul Ryan: In selecting Ryan as his running mate, Mitt Romney put Ryan and his ideas front-and-center in the election. Voters said thanks but no thanks to Ryan and his radical ideas. Ryan even lost his hometown of Janesville, Wisconsin.
  2. A Republican House of Representatives: President Obama was easily re-elected and Democrats expanded their majority in the Senate, so why are we stuck with a GOP-controlled House of Representatives? Gerrymandering. Democratic House candidates won more than a million more votes than Republican candidates, but districts drawn by Republicans for Republicans allowed the GOP to hold on to their majority. This isn’t even disputed by the Republicans. In fact, they brag about it.
  3. The Middle Class Footing the Bill: The centerpiece of Mitt Romney and Paul Ryan’s economic proposal was a tax plan that raised taxes on the poor and middle class in order to slash taxes for the wealthy. By contrast, President Obama proposed raising taxes on the wealthiest Americans. The GOP budget’s tax proposals is nearly identical to the Romney-Ryan plan rejected by voters in November.
  4. Ending Medicare: Mitt Romney not only chose Paul Ryan, he wholeheartedly embraced Ryan’s controversial plan to end Medicare as we know it and replace it with a voucher system that stands to double seniors’ out-of-pocket health care costs. Romney and Ryan lost key states with senior-heavy populations, including Florida, Pennsylvania, Iowa, and New Hampshire.
  5. Repealing Obamacare: Not only did voters not vote for the team that wanted to repeal Obamacare, Mitt Romney says that the president won because of Obamacare. Nevertheless, the GOP budget plan to be unveiled tomorrow will once again call for repealing Obamacare — except for its $716 BILLION in savings from Medicare. Despite demonizing the president for the cuts throughout the campaign, Ryan’s plan keeps those cuts in order to to pay for new tax breaks for the wealthy and special interests like Big Oil and Wall Street banks.
  6. European-Style Austerity: Mitt Romney and Paul Ryan proposed unrealistic draconian spending cuts, while the president proposed investments that will create jobs now and grow the middle class and our economy over the long run. The American people rejected the former and gave an Electoral College landslide to the latter. Nevertheless, the GOP budget plan will feature the kind of unrealistic draconian spending cuts that will make it impossible to make investments in the middle class.The GOP plan will slow down the economy and kill hundreds of thousands of jobs. It’s the same kind of austerity that has led to shrinking economies and record-high unemployment in Europe. Austerity isn’t working there and it won’t work here.

BOTTOM LINE: Paul Ryan and his policies were soundly rejected by voters last November. Instead of doubling down on extreme and unpopular ideas like ending Medicare as we know it and raising taxes on the middle class in order to slash taxes on the wealthy, Republicans should come back to the table and agree to deal with our fiscal challenges in a responsible, balanced manner.

If you watched Thursday night’s debate, I don’t need to tell you that Vice President Biden scored a decisive victory.
The Vice President brought facts and conviction to Danville, Kentucky, and Paul Ryan brought canned lines and empty promises. It turns out, facts and details matter — and it’s clear that with their total disregard for both, Mitt Romney and Paul Ryan know their plans for this country are indefensible.
In case you know people who missed the debate, share some of the highlights with them:
The difference on taxes :  Ryan couldn’t explain how the Romney-Ryan tax plan wouldn’t hurt the middle class. That’s because it’s mathematically impossible to pay for their $5 trillion tax plan favoring the wealthiest without raising taxes on middle-class families. Watch the clip of Vice President Biden pointing this out, then watch the Vice President explaining the Obama-Biden tax plan— and be sure to share with others:

The President has a clear plan to end the war in Afghanistan in 2014, while Romney has been all over the map. Women’s health :  When Ryan was asked to ensure women that their right to choose would be protected, he refused to answer because they wouldn’t.
