Following any Leader remarks, the Senate will be in a period of morning business for one hour with Senators permitted to speak therein for up to 10 minutes each with the Majority controlling the first half and the Republicans controlling the final half.
Following morning business, the Senate will resume consideration of H.R.2354, the Energy & Water Appropriations bill.

Following morning business on Thursday, November 16, 2011, the Senate will begin consideration of S.1867, the Department of Defense Authorization Act. The Senate is now in a period of morning business. There will be no roll call votes today.

Senator Reid expressed his intention to return to the consideration of H.R.2354, the Energy and Water Appropriations Act when the Senate can reach an agreement regarding amendments to that bill. The unofficial transcript of Senator Reid’s remarks is below.

MR. REID: MR. PRESIDENT, WE STARTED OUT THIS WEEK HOPING WE COULD COMPLETE A MINIBUS. WHAT THAT MEANS IS TO DO WHAT WE DID A COUPLE OF WEEKS AGO AND COMPLETE THREE APPROPRIATION BILLS AT THE SAME TIME. WE HAD THREE GOOD SUBJECTS OF THAT, WE HAD THE UNDERLYING BILL WHICH WAS ENERGY AND WATER, WE MOVED FROM THAT WE ADDED TO THAT FINANCIAL SERVICES, AND FOREIGN OPERATIONS. WE WERE UNABLE TO GET A CONSENT AGREEMENT THAT WE COULD TREAT THE PACKAGE OF BILLS THE SAME WAY WE TREAT OTHER APPROPRIATION BILLS. THAT IS, THERE IS A — THERE IS — YOU CAN’T LEGISLATE ON AN APPROPRIATION BILL AND IT HAS TO BE A GERMANE AMENDMENT. SO WE DIDN’T GET THAT AGREEMENT WHICH I WAS DISAPPOINTED, IT’S REALLY TOO BAD BUT THAT’S THE WAY IT IS. I ACCEPT THAT. THE BEST NEWS OUT OF THIS IS WE HAVE WITH THE UNDERLYING BILL TWO OF THE FINEST SENATORS THAT WE HAVE IN THE SENATE OR HAVE EVER HAD, ACTUALLY, SENATORS FEINSTEIN AND SENATOR ALEXANDER. THEY ARE KNOWLEDGEABLE, THEY’RE EASY TO WORK WITH, AND THEY UNDERSTAND THAT LEGISLATION IS THE ART OF COMPROMISE. TO WORK THROUGH ISSUES. AND THEY’VE DONE A WONDERFUL JOB IN THE LAST 24 HOURS BREAKING DOWN THE AMENDMENTS. WE HAVE A NUMBER OF AMENDMENTS ON THE REPUBLICAN SIDE, A FINITE LIST OF AMENDMENTS. WE SHOULD HAVE THE DEMOCRATIC SIDE OF THOSE VERY QUICKLY. I THINK WE NEED TO WORK IT DOWN A LITTLE MORE, BUT I APPRECIATE VERY MUCH THE GOOD WORK OF SENATOR ALEXANDER AND SENATOR FEINSTEIN. NOT EVERYTHING IS WORKED OUT IN IT BUT THAT’S NOTHING THAT’S UNUSUAL. THIS IS A HUGE BILL. SENATORS LEVIN, McCAIN, LINDSAY GRAHAM, AND OTHERS HAVE WORKED VERY HARD TO TRY TO WORK OUT ONE OF THE PROBLEM AREAS WE’VE HAD AND SIGNIFICANT PROGRESS HAS BEEN MADE THERE. IT REALLY DOESN’T MATTER. I’VE SPOKEN TO ONE DEMOCRATIC SENATOR AND HE STILL ISN’T REAL HAPPY ABOUT THAT INFORMATION THAT’S IN THAT BILL BUT I TOLD HIM THAT WE OFFER AN AMENDMENT VERY QUICKLY AND HE COULD TRY TO ASSERT HIS POSITION. I THINK THAT’S HOW WE SHOULD DO THINGS AROUND HERE.

Following the prayer and pledge, there will be a period of morning business until 11am, with Senators permitted to speak therein for up to 10 minutes each. The Majority will control the first half and the Republicans will control the next half.
At 11am, the Senate will proceed to Executive Session to consider the nominations of Sharon Gleason, to be U.S. District Judge for the District of Alaska, and Yvonne Rogers, to be U.S. District Judge for the district of Northern California. There will be 1 hour for debate prior to votes on confirmation of the nominations. Therefore, senators should expect a series of 2 roll call votes to begin at noon.
Following the votes, the Senate will recess until 2:15pm to allow for the weekly caucus meetings.
At 2:15pm, the Senate will resume consideration of H.R. 2354, the Energy and Water appropriations bill.

When the Senate resumed consideration of HR 2354, the Energy and Water appropriations bill, Senator Reid withdrew the committee reported substitute amendment. He then offered a new substitute amendment #956, which included the text of Energy and Water, Financial Services/General Government; and State/Foreign Operations appropriations. Senator Menendez raised a Rule 16 point of order that was well taken and the amendment fell.

Senator Reid then offered a new substitute (Reid amendment #957), which includes the 3 appropriations bills minus the offending Cuba related language.

The Divisions of the Reid substitute amendment #957 are as follows:

Division A: text of the withdrawn committee-reported amendment (Energy and Water appropriations)

Division B: text of Calendar #171, S.1573 with the exception of sections 620 and 624 (Financial Services/General Government appropriations minus the offending Cuba language)

Division C: text of Calendar #179, S.1601 (State/Foreign Operations appropriations)

Senator Reid then asked consent that HR 2434, as reported by the House Appropriations Committee and Division C of amendment #957 be deemed House passed text in HR 2354 for purpose of Rule 16 and that amendment #957 for the purposes of paragraph 1 Rule 16 be considered a committee amendment. In English, that means Senator Reid was seeking consent to use the following bills for defense of germaneness purposes: HR 2354 (Energy and Water), HR 2434 (Financial Services), S.1601 (State/Foreign Operations).

Senator Moran objected to Senator Reid’s request and Senator Vitter also spoke in opposition to the request.

Senator Reid then filled the amendment tree so that we can continue to work on an agreement to consider the Energy and Water appropriations bill.

Stop Michigan‘s “license to bully” bill

When Katy Butler was in junior high, bullies who called her a “dyke” slammed a locker door on her hand. Katy never reported the assault because she was afraid her school wouldn’t do anything to help.

If the Michigan state Senate has its way, Katy’s school won’t have to help students bullied in the future, either.

Last week, the Michigan state Senate passed an anti-bullying bill. But minutes before they voted, Republican lawmakers inserted special language into the bill to create a huge loophole: Bullying done because of a “sincerely held religious or moral conviction” isn’t covered by the law.

Rather than protecting students, the new law actually provides a road map that teaches kids how to bully — and how to get away with it.

Katy and her friend Carson Borbely know what it’s like to be bullied for who they are. They started a Change.org petition demanding that the state legislature enact a strong anti-bullying law with no exceptions. The Michigan House of Representatives will consider the Senate’s weak anti-bullying bill soon. Katy and Carson want them to strengthen the bill and eliminate the religious exemption inserted by the state Senate, and Change.org members are rallying around their demand.

Some legislators are wavering in the face of public outrage, and Republican Speaker of the House Jase Bolger is now said to be considering a stronger, more comprehensive version of the bill. But Katy and Carson need your help to keep up the pressure.
