the Senate Convened at 10:00amET December 16, 2011

Following any Leader remarks, the Senate will be in morning business until 12:00pm with Senators permitted to speak therein for up to 10 minutes each with the first hour equally divided and controlled between the Leaders or their designees with the Majority controlling the first 30 minutes and the Republicans controlling the next 30 minutes.
We continue to work on an agreement to consider the omnibus spending bill and a payroll tax compromise. As a reminder to all Senators, cloture was filed on the motion to proceed to H.R.3630, the House Republican Payroll Tax bill. Unless an agreement is reached, that vote will occur Saturday morning.

Morning business has been extended until 5:00pm. This morning, Senator Reid announced Senators should expect roll call votes tomorrow, Saturday, December 17^th. The unofficial transcript of Senators Reid and McConnell’s remarks is below.

LEADER, TAKES THE VIEW THAT IF IT’S PASSED ONE HOUSE, THERE

WILL NOT BE A GOVERNMENT SHUTDOWN. SO I THINK EVERYBODY SHOULD

BE REASSURED THAT’S NOT GOING TO HAPPEN. THE CONFERENCE REPORT

HAS BEEN SIGNED AND WE’RE MOVING TOWARD COMPLETING THE BASIC

WORK OF GOVERNMENT THROUGH NEXT SEPTEMBER 30 VERY SHORTLY. ON

THE SECOND ISSUE, THE MAJORITY LEADER AND I ARE MAKING

SIGNIFICANT PROGRESS AND REACHING AN AGREEMENT ON A PACKAGE

THAT WILL HAVE BIPARTISAN SUPPORT, I HOPE. I THINK WE’RE GOING

TO GET TO THAT PLACE. AND I SHARE HIS VIEW THAT GOOD PROGRESS

IS BEING MADE.

The Senate is now in recess subject to the call of the Chair. When the Senate reconvenes, another message will be sent.

The Senate has reached an agreement with respect to the 2 month extension of payroll tax, UI, SGR, and other tax extenders, disaster aid funding, and the Omnibus Appropriations conference report,.

As a result of this agreement, senators should expect a series of up to 4 roll call votes at approximately 9:00am tomorrow in relation to the following items:

– Reid substitute amendment to H.R.3630, 2 month extension of the payroll tax reduction, doc fix, and unemployment insurance (60-vote threshold);

((up to 15 minutes for debate))

– Passage of H.R.3672, emergency disaster funding (60-vote threshold);

– Adoption of H.Con.Res.94, a correcting resolution to provide offsets for the emergency disaster funding (60-vote threshold); and

– Adoption of the conference report to accompany H.R.2055, Omnibus Appropriations (60-vote threshold).

The agreement is as follows:

At 9am, Saturday, December 17^th, the Senate will proceed to the consideration of Calendar #257, H.R.3630. The Majority Leader be recognized to offer a Reid-McConnell substitute amendment agreed to by both Leaders – a two month extension of the payroll tax reduction, doc fix and unemployment insurance.

Following the reporting of the amendment, the Senate will proceed to vote in relation to the substitute. No amendments are in order to the substitute or the bill prior to the vote. The amendment is subject to a 60 vote threshold. If the substitute amendment is agreed to, the bill, as amended, will be read a third time and passed; if the Reid-McConnell substitute amendment is not agreed to, the Majority Leader will be recognized.

Upon disposition of H.R.3630, the Senate will proceed to the consideration of the conference report with respect to H.R.2055 (Omnibus appropriations). There will be 15 minutes of debate – 5 minutes each for Senators Inouye, Cochran and McCain.

Upon the use or yielding back of time, the conference report will be temporarily set aside and, notwithstanding the lack of receipt of the papers from the House with respect to H.R.3672, the Senate proceed to the consideration, en bloc, of the following items: H.R.3672, a bill regarding emergency disaster funding and H.Con.Res.94, a correcting resolution to provide offsets for the emergency disaster funding. There will be no amendments in order to the bill or the concurrent resolution prior to votes in relation to those measures. Following the reporting of the bill and the concurrent resolution, the Senate proceed to votes on the measures in the following order:

– Passage of H.R.3672;

– Adoption of H.Con.Res.94; and

– Adoption of the Conference Report to Accompany H.R.2055, the Omnibus Appropriations bill.

There will be two minutes equally divided prior to each vote. Each of the votes will be subject to a 60 affirmative vote threshold. No motions or points of order be in order prior to the votes other than budget points of order and the applicable motions to waive. Further, the cloture motion with respect to the motion to proceed to H.R.3630 was vitiated. Finally, the House be immediately notified of the Senate’s action following the votes.

WHAT THAT MEANS IS TO DO WHAT WE DID A COUPLE OF WEEKS AGO AND COMPLETE THREE APPROPRIATION BILLS AT THE SAME TIME. WE HAD THREE GOOD SUBJECTS OF THAT, WE HAD THE UNDERLYING BILL WHICH WAS ENERGY AND WATER, WE MOVED FROM THAT WE ADDED TO THAT FINANCIAL SERVICES, AND FOREIGN OPERATIONS. WE WERE UNABLE TO GET A CONSENT AGREEMENT THAT WE COULD TREAT THE PACKAGE OF BILLS THE SAME WAY WE TREAT OTHER APPROPRIATION BILLS. THAT IS, THERE IS A — THERE IS — YOU CAN’T LEGISLATE ON AN APPROPRIATION BILL AND IT HAS TO BE A GERMANE AMENDMENT. SO WE DIDN’T GET THAT AGREEMENT WHICH I WAS DISAPPOINTED, IT’S REALLY TOO BAD BUT THAT’S THE WAY IT IS. I ACCEPT THAT. THE BEST NEWS OUT OF THIS IS WE HAVE WITH THE UNDERLYING BILL TWO OF THE FINEST SENATORS THAT WE HAVE IN THE SENATE OR HAVE EVER HAD, ACTUALLY, SENATORS FEINSTEIN AND SENATOR ALEXANDER. THEY ARE KNOWLEDGEABLE, THEY’RE EASY TO WORK WITH, AND THEY UNDERSTAND THAT LEGISLATION IS THE ART OF COMPROMISE. TO WORK THROUGH ISSUES. AND THEY’VE DONE A WONDERFUL JOB IN THE LAST 24 HOURS BREAKING DOWN THE AMENDMENTS. WE HAVE A NUMBER OF AMENDMENTS ON THE REPUBLICAN SIDE, A FINITE LIST OF AMENDMENTS. WE SHOULD HAVE THE DEMOCRATIC SIDE OF THOSE VERY QUICKLY. I THINK WE NEED TO WORK IT DOWN A LITTLE MORE, BUT I APPRECIATE VERY MUCH THE GOOD WORK OF SENATOR ALEXANDER AND SENATOR FEINSTEIN. THE NORMAL PROCESS WOULD BE TO PULL THE BILL AND COME BACK SOME OTHER TIME. WE’RE NOT GOING TO DO THAT. WE’RE GOING TO HAVE THE BILL ON THE CALENDAR OF THE SENATE SO WE CAN MOVE TO IT AT A MINUTE’S NOTICE, REALLY. AND WE’LL KEEP THIS AROUND, WE HOPE TO BE ABLE TO MOVE TO THAT SOON. THIS WILL GIVE US THE OPPORTUNITY TO MOVE TO THE DEFENSE AUTHORIZATION BILL. I INDICATED SENATORS LEVIN AND SENATOR McCAIN, WELL MORE THAN A MONTH AGO I WOULD MOVE TO THIS BILL. NOT EVERYTHING IS WORKED OUT IN IT BUT THAT’S NOTHING THAT’S UNUSUAL. THIS IS A HUGE BILL. SENATORS LEVIN, McCAIN, LINDSAY GRAHAM, AND OTHERS HAVE WORKED VERY HARD TO TRY TO WORK OUT ONE OF THE PROBLEM AREAS WE’VE HAD AND SIGNIFICANT PROGRESS HAS BEEN MADE THERE. IT REALLY DOESN’T MATTER. I’VE SPOKEN TO ONE DEMOCRATIC SENATOR AND HE STILL ISN’T REAL HAPPY ABOUT THAT INFORMATION THAT’S IN THAT BILL BUT I TOLD HIM THAT WE OFFER AN AMENDMENT VERY QUICKLY AND HE COULD TRY TO ASSERT HIS POSITION. I THINK THAT’S HOW WE SHOULD DO THINGS AROUND HERE.

When the Senate resumed consideration of HR 2354, the Energy and Water appropriations bill, Senator Reid withdrew the committee reported substitute amendment. He then offered a new substitute amendment #956, which included the text of Energy and Water, Financial Services/General Government; and State/Foreign Operations appropriations. Senator Menendez raised a Rule 16 point of order that was well taken and the amendment fell.

Senator Reid then offered a new substitute (Reid amendment #957), which includes the 3 appropriations bills minus the offending Cuba related language.

The Divisions of the Reid substitute amendment #957 are as follows:

Division A: text of the withdrawn committee-reported amendment (Energy and Water appropriations)

Division B: text of Calendar #171, S.1573 with the exception of sections 620 and 624 (Financial Services/General Government appropriations minus the offending Cuba language)

Senator Reid then asked consent that HR 2434, as reported by the House Appropriations Committee and Division C of amendment #957 be deemed House passed text in HR 2354 for purpose of Rule 16 and that amendment #957 for the purposes of paragraph 1 Rule 16 be considered a committee amendment. In English, that means Senator Reid was seeking consent to use the following bills for defense of germaneness purposes: HR 2354 (Energy and Water), HR 2434 (Financial Services), S.1601 (State/Foreign Operations).

The Senate will convene on Monday, October 24, 2011 at 3:45pm and on Thursday, October 27, 2011 at 11am for pro forma sessions only with no business conducted.

The next roll call vote will be at approximately 5:30pm on confirmation of the Higginson nomination.

The next roll call vote is expected to occur on Monday, October 31^st in relation to a nomination. The details of the amended consent agreement with respect to H.R.2112 is below.

Cloture having been invoked on the Inouye substitute amendment #738, the substitute amendment is agreed to and it is now considered original text for the purposes of further amendment. The remaining amendments which were scheduled for votes today remain in order notwithstanding cloture having been invoked; when the Senate resumes consideration of H.R.2112 on Tuesday, November 1^st, the Senate will proceed to votes on the remaining amendments; and all other provisions of the previous order remain in effect.

The following amendments were agreed to by voice vote, en bloc:
