The Senate stands adjourned until 9:30am on Thursday, March 27, 2014.

Following any Leader remarks, the Senate will be in a period of morning business until 10:30am with the Majority controlling the first half and the Republicans controlling the final half.

 Following morning business, the Senate will proceed to the consideration of H.R.4152, the Ukraine bill. The time until noon will be equally divided and controlled between the two Leaders or their designees.

 At noon, there will be up to 3 roll call votes:

–        Adoption of the Menendez-Corker substitute amendment #2867

–        Passage of H.R.4152, as amended, if amended, and

 During Wednesday’s session, cloture was filed on the motion to proceed to H.R.3979, the legislative vehicle for the Unemployment Insurance Compensation Extension and on Executive Calendar #573, John B. Owens, of CA, to be US Circuit Judge for the Ninth Circuit. Under the rule, the first cloture vote would occur Friday morning; it is possible one or both could be moved to Thursday.

At 12:00pm, the Senate began a 15 minute roll call vote on Menendez-Corker substitute amendment to H.R.4152, Ukraine;

The Senate passed H.R.4152, as amended, if amended (Ukraine) by voice vote.

The Senate confirmed Executive Calendar #689 Maria Contreras-Sweet, to be Administrator of the Small Business Administration, by voice vote.

By consent, at 1:45pm today, the Senate will proceed to a cloture vote on Executive Calendar #573, John B. Owens, of CA, to be US Circuit Judge for the Ninth Circuit that and then, notwithstanding rule 22, the Senate will proceed to vote on the motion to invoke cloture on the motion to proceed to H.R.3979.

 

Further, if cloture is invoked on the Owens nomination, all post cloture time will be considered expired at 5:30pm, Monday, March 31st, and the Senate will proceed to vote on confirmation of the Owens nomination. Upon disposition of the Owens nomination, the Senate resume Legislative Session and, if cloture is invoked on the motion to proceed to H.R.3979, then all post-cloture time be considered expired and the Senate proceed to consideration of the  bill.

 

Following the cloture vote on motion to proceed to H.R.3979 today, there will be 2 minutes for debate equally divided prior to a vote on confirmation of Confirmation of Executive Calendar #700, Mathew H. Tueller, to be Ambassador to the Republic of Yemen.

 

There is still hope that we reach an agreement on the SGR legislation today. Another message will be sent if and when any agreement is reached.

The Senate received H.R.3771, the Philippines Charitable Giving Assistance Act from the House. H.R.3771 is identical to the text of S.1821, a bill to accelerate the income tax benefits for charitable cash contributions for the relief of victims of Typhoon Haiyan in the Philippines (which was passed by the Senate on March 6, 2014). Under a previous order, the Senate passed H.R.3771 by unanimous consent.

This morning, the Senate also reached consent to recess from 12:30pm until 2:15pm to allow for the weekly caucus meetings.  The time during the recess will count post-cloture on the motion to proceed to S.2124, the Ukraine Act.

The Senate received H.R.4275, the Cooperative and Small Employer Charity Pension Flexibility Act. H.R.4275 is identical to the text of S.1302, an act to amend the Employee Retirement Income Security Act of 1974 and the Internal Revenue Code of 1986 to provide cooperative and small employer charity pension plans, as passed by the Senate on January 28, 2014. Cornyn request for Barrasso liquefied natural gas and unlimited amendments to Ukraine legislation

Prior to reaching the agreement, Senator Cornyn asked unanimous consent that the Ukraine consent request be modified so that the first amendment in order be a Barrasso amendment related to liquefied natural gas, and that following disposition of the Barrasso amendment, the Majority Leader and the Minority Leader, or their designee, be recognized to offer relevant amendments in an alternating fashion. Senator Reid objected to the request and the original request was agreed to.

Senator Reid then moved to proceed to Calendar #333, H.R.3979, which will be the legislative vehicle used for the Unemployment Insurance extension legislation.

As a result of these agreements, there will be several votes on Wednesday and Thursday. We expect additional votes this week beyond the votes set up by this agreement, including, but not limited to, a potential cloture vote on the motion to proceed to the legislative vehicle for the Unemployment Insurance extension.

The Senate will meet on the following dates at the following times for pro forma sessions only with no business conducted:

–        Friday, March 14th at 10:30am

–        Tuesday, March 18th at 10:30am and

–        Friday, March 21st at 9:00am.

The Senate will convene at 2:00pm on Monday, March 24, 2014.

Following any Leader remarks, the Senate will resume consideration of the motion to proceed to S.2124, the Ukraine Act.

 At 5:30pm, there will be a roll call vote on the motion to invoke cloture on the motion to proceed to S.2124.

 As a reminder to all Senators, on Thursday, March 13th, cloture was filed on the following items in the following order:

 –          Motion to proceed to Calendar #329, S.2124, a bill to support sovereignty and democracy in Ukraine, and for other purposes.

–          Executive Calendar #581, Christopher Reid Cooper, of D.C., to be U.S. District Judge for D.C.

–          Executive Calendar #582, M. Douglas Harpool, of Missouri, to be U.S. District Judge for the Western District of Missouri

–          Executive Calendar #583, Gerald Austin McHugh, Jr., of Pennsylvania, to be U.S. District Judge for the Eastern District of Pennsylvania and

–          Executive Calendar #584, Edward G. Smith, of Pennsylvania, to be U.S. District Judge for the Eastern District of Pennsylvania.

 As a reminder when cloture is filed sequentially on several items, the Senate will consider one motion at a time. If cloture is invoked on the motion to proceed to S.2124 and once the motion to proceed is adopted (30 hours after cloture is invoked) or if cloture is not invoked, the Senate will proceed to Executive Session and vote on the next motion to invoke cloture on the Cooper nomination.  If cloture is invoked on any of the US District Judge nominations, there will be up to 2 hours of debate equally divided and controlled on the nomination prior to confirmation of the nomination.
