The Attacks on Women’s Health Keep Coming

It’s only January 15, but Republican legislators and their activist allies are not wasting any time when it comes to the war on women. Just today, both the Supreme Court and Congress considered new restrictions that could limit basic access to abortion.

1. A panel of House Republicans, all of which are men, is advancing a bill that contains far-reaching restrictions on abortion access. The bill, the so-called Rape Audit, H.R. 7, aims to limit access to abortion by making it much more difficult for women to purchase private insurance that covers abortion (as most private plans currently do) with their own money. (Similar laws were passed by seven states last year.) In addition to increasing taxes on women and small businesses, it would also empower the IRS to conduct audits of rape survivors to ensure they’re not merely pretending to be raped. Pro-choice legislators and advocates have been pushing back against this assault, including a group of Democratic congresswomen who sternly told the GOP to “stop wasting taxpayers’ time and dollars waging attacks on women’s constitutionally protected right to make informed health care decisions about their own bodies.”

Rep. Bob Goodlatte (R-VA), who chairs the Judiciary Committee, claimed the bill is actually a jobs plan because denying women access to abortions will make them have more children, who will in turn help grow the economy. Another leading anti-abortion legislator, Rep. Trent Franks (R-AZ), blocked a Democratic effort to amend the bill with legislation that cracks down on workplace discrimination against pregnant women by claiming that abortion access has nothing do with pregnant women.

2. The Supreme Court may rule to eliminate buffer zones at abortion clinics, allowing protesters almost unlimited access to patients and staff. Depending on how the Justices rule in McCullen v. Coakley, a case they heard today, cities and states may no longer be allowed to enact buffer zones around reproductive health care facilities. Since protests outside of clinics often turn violent, abortion providers say that buffer zones are critical for ensuring the safety of their patients and staff. In fact, there have been over 4,700 incidents of clinic violence and 140 clinic blockades since 1995.

Justices Scalia and Alito incredulously claimed that anti-abortion activists who gather outside clinics and harass patients and staff aren’t actually even protesting, they merely want to “speak quietly” to patients. It appears likely that Alito, Scalia, Kennedy (who has long opposed buffer zones) will be able to find at least two other justices to strike down the Massachusetts law and perhaps overturn a 2000 ruling that upheld a similar law in Colorado.

It’s worth noting that the Supreme Court bans protests on its own plaza.

3. In the past 3 years, states have enacted more abortion restrictions than during the entire previous decade. A new report from the Guttmacher Institute notes that between 2011 and 2013, state legislatures enacted 205 laws that restrict women’s reproductive rights. In the decade prior, between 2001 and 2010, states enacted 189 such restrictions. While the campaign against abortion rights rages on nationwide, Guttmacher points out that the multiple, often overlapping restrictions enacted just a few states — North Dakota, Texas, Arkansas, and North Carolina — helped drive the spike.

4. States with anti-choice governors and state legislatures outweigh states with pro-choice ones. The two charts below illustrate the imbalance. And in a new state-by-state report card released this week by NARAL Pro-Choice America, 25 states receive a failing grade for reproductive rights while America on the whole gets just a ‘D’ grade.

BOTTOM LINE: Women’s health advocates are hopeful that this year will prove to be a turning point in the fight over women’s reproductive rights, but so far we’re seeing more of the same from their opponents.

Rights Versus Resources in the Amazon

Tar sands, hydraulic fracking, deep water drilling. All are examples that we are living in the age of extreme oil. With most major reserves of traditional crude found or tapped, the industry is encroaching into some of the most geologically-complicated, environmentally-risky and socially-conflictive terrain than ever before. As the price of crude hovers at $100, companies are eager to get at what was once impossible crude, much to the peril of people and the planet.

In some cases, this means pursuing non-conventional sources of oil, once technologically or financially out of reach, but now lucrative, despite being more energy intensive to extract than the final crude produced. In other cases, this means attempting to access “shut in” reserves – oil fields trapped by local resistance or above-ground ecological importance.

There is no greater example of this clash than what is playing out in the forests of Ecuador’s Amazon. There is a new oil boom underway, fuelled by the country’s rising debt, China’s energy demands, Ecuador’s leftist government’s plans to finance its “citizen’s revolution”, and the massive increase in public spending with expanded drilling.

According to documents ColorOfChange obtained from the highly-secretive American Legislative Exchange Council (ALEC) last month, user-review site Yelp! joined ALEC — and gave the group at least $10,000 — during the opening week of George Zimmerman‘s murder trial.

More than 50 corporations have pulled their funding from ALEC over its responsibility for deadly so-called “Stand Your Ground” — or “Shoot First” — laws. It’s due to Shoot First that Zimmerman was not only acquitted of all criminal charges for his confessed killing of unarmed teen Trayvon Martin,¹ but will likely be immune to any civil penalty for wrongful death.²

Pressed to explain the company’s bizarre decision to join ALEC now, Yelp!’s Director of Public Policy admitted he “can’t ignore” the damage ALEC has done.³ But the company is suppressing thousands of negative reviews posted to ALEC’s Yelp! page opposing the move, and Yelp!’s CEO has made every effort to sidestep the growing controversy. To cut through Yelp!’s filter and reach company decisionmakers directly, ColorOfChange is launching a new site — TELLYELP.NO — that drives home the harm Yelp! inflicts on our communities by funding ALEC.

In the wake of Zimmerman’s acquittal, Shoot First — with its legal presumption that subjective, racist fears are justifiable grounds for vigilante homicide — has served to paint a target on the backs of Black youth.⁴ Shoot First endangers millions of people living in more than two dozen states, and there is now eight years of available data on the laws’ racially-biased outcomes.⁵ But ALEC has taken no steps to repeal Shoot First laws in the states where they’re on the books — nor to stop ALEC legislators from continuing to introduce new ones. Ten Shoot First bills have been introduced so far in 2013, and two have passed.⁶

ALEC is a bill mill that thrives on millions in fungible corporate “membership,” “scholarship” and “sponsorship” monies;⁷ this explicit pay-to-play legislation pipeline ensures that ALEC will continue to produce extreme profit-driven laws⁸ that exploit and endanger our communities. By funding it, Yelp! is directly furthering all aspects of the ALEC legislative agenda, and is responsible for the harms caused by the laws that result.

Join us in urging Yelp!’s CEO to withdraw funding from ALEC and TELLYELP.NO now. And when you do, please ask your friends and family to do the same.

We defied some pretty big trends in this past election:

For the first time in almost four decades, the winning candidate in Virginia’s governor’s race is from the same party as the president.
For the first time in more than twenty years, we elected a Democratic mayor of New York City.
In St. Petersburg, Florida we defeated an incumbent Republican mayor, the first time that’s happened in two decades.
In Pasco County, Florida, we won a special election for a legislative seat that had been held by Republicans for nearly twenty years.

At one point or another, the cynics and the pundits looked at all of those races, pointed to the history, and said Democrats didn’t have much of a chance. But because supporters like you stepped up, we proved them wrong.

So when people tell you that Democrats can’t take back the 17 seats that we need to win back the House, don’t get mad — get to work and prove them wrong, as well.

If you look at Tuesday’s exit polls from Virginia — a swing state — you see an electorate that looked a lot like the one that showed up to vote for President Obama in 2012. A lot of pundits were saying that would never happen, too.

Recent polling shows Democrats up in 48 congressional races that we need to win 17 of in order to take back the House. If we can do across the country what we did in Virginia — get our Democratic coalition to show up on Election Day — we could be in for a good night next November.

But that won’t happen unless we stand together to put winning plans into action.

GOP Rejects Own Plan to Keep Government Open

CHART: Democrats Have Already Negotiated & Compromised

Republicans continue to falsely claim that President Obama and Democrats won’t negotiate over the budget. That’s just not true.

In fact, Senate Democrats even tried once again this afternoon to launch a formal conference committee to hash out a budget through September of 2014, but Republicans blocked their request, as they have on 19 previous occasions since the Senate passed a budget over six months ago.

What is true is that Democrats refuse to negotiate over keeping the government open and paying the bills that Congress has already racked up. Those items should be non-negotiable. They are simply Congress’ job.

As soon as the GOP brings these latest manufactured crises to an end — as they could at literally any moment if they simply allow the House of Representatives to vote on a clean government funding bill and a bill that guarantees that Congress will not allow an unprecedented and catastrophic default on our obligations — Democrats are more than happy to negotiate on the actual budget.

In fact, they have done plenty of negotiating already. The clean bill to re-open the government is already a huge compromise and agrees to the sequester spending levels that Republicans demanded and promised to bring to a vote mere months ago.

This compromise bill was Speaker Boehner’s own idea and Majority Leader Eric Cantor (R-VA) touted it as a major victory for House Republicans just last month, but now they refuse to even allow the House to vote on it. Worse, Republicans continue to threaten to unleash a “financial apocalypse” on the global economy as soon as next week unless the president and Democrats agree to their laundry list of Tea Party demands.

BOTTOM LINE: Unless Congress acts, we’ll face a global economic calamity next week. Americans across the country — including the family members of our troops killed in action — are already suffering because the GOP shut down the government in a failed effort to deny affordable health insurance to millions.

It’s time for these manufactured crises to end. Republicans just need to allow the House of Representatives to vote on a clean government funding bill and a bill that guarantees that Congress will pay our nation’s bills.
