North Dakota GOP Lawmaker Proposes Bill That Would Let Motorists Run Over Pipeline Protesters

Republican politician shows contempt for the United States Constitution.

As Donald Trump takes office, pushing a wave of explicitly authoritarian federal policies and practices, Republican leaders at every level are following suit. The latest example is North Dakota lawmaker Keith Kempenich, who has introduced a bill that would let drivers who run down protesters blocking roads and other thoroughfares go scott free.

The $3.8 billion Dakota Access Pipeline, which would span 1,100 miles and include Sioux land at the Standing Rock reservation, was halted in December after months of high-profile protests. Kempenich, who spoke to the Bismarck Tribune, candidly admitted that he created the legislation in response to protests against the pipeline project.

“It’s shifting the burden of proof from the motor vehicle driver to the pedestrian,” Kempenich told the newspaper. The state representative went on to justify his bill, which would allow motorists to potentially maim or kill protesters using a vehicle—thousands of pounds of fast-moving metal—but complained that protesters are “intentionally putting themselves in danger.”

Kempenich says his bill, which is in opposition to the United States Constitution and its First Amendment-granted rights of free speech, is the result of his mother-in-law being inconvenienced while driving through protests. The lawmaker cited an instance when, as his mother-in-law drove past a long line of cars parked along the shoulder of the road, a protester jumped in front of her car waving a sign. It seems just as likely that the protester emerged from a blind spot created by the stationary cars, as can happen in any situation where parked vehicles create a visual barrier. It’s impossible to say definitively, since neither Kempenich nor any of the other six Republican sponsors of the bill—Michael Brandenburg, Vernon Laning, Bill Oliver, Karen Rohr, Dwight Cook and Donald Schaible—were there at the time.

“It’s shocking to see legislation that allows for people to literally be killed for exercising their right to protest in a public space,” Tara Houska, a Native activist who works with environmental organization Honor the Earth, told NBC News. “These [bills] are meant to criminalize the protests with no real concern for constitutional law.”

In Washington State, Republican Senator Doug Ericksen has proposed a law that would create “a new crime of economic terrorism” which could allow for the arrest and prosecution of any protesters who “block transportation and commerce, cause property damage, threaten jobs and put public safety at risk.”

Ericksen is likely well aware of the fact that “blocking commerce” succinctly describes pretty much every protest ever. Republican Representative Kathy Lohmer of Stillwater, Minnesota, is floating a bill that further criminalizes and penalizes protesting on freeways. Lohmer’s legislation would increase fines from $1,000 to $3,000 and raise jail time from 90 days to a full year.

Donald Trump just confirmed that he is ramming through approval of the Dakota Access Pipeline.1 This is an unprecedented move by a sitting President.2 The approval and construction of this pipeline will wipe out the Sioux’s “most important cultural and spiritual areas.” The $3.8 billion Dakota Access Pipeline will contaminate the reservation’s water and will constitute yet another attack on their sovereignty and way of life.3

This is just the first of many actions Trump and the GOP plan to take to use infrastructure projects to destroy the lives of people of color. Today he’ll ram this pipeline through the Sioux community, tomorrow he will push through a lung-choking oil refinery in a Black neighborhood.

But this fight is far from over. The bureaucrats of the Army Corp of Engineers – the agency overseeing the pipeline construction – still have a lot of power to delay and block this project. We need to call on staff within Army Corp of Engineers to oppose Trump by throwing sand in the gears of this destructive project. With their help we can stall this out.

As long as corporations partner with Trump and the GOP to threaten the land, the water, and the planet, there will be water protectors and land defenders ready to put their bodies on the line. But we need people of conscious on the inside of the government to take action too.

Trump’s power depends on the consent of the people and it’s institutions in order to function. Trump already knows he doesn’t have the consent of the people, it’s time to show him that he doesn’t have the consent of our institutions either. Weakening Trump’s hold on institutions like the Army Corp of Engineers is the key to undermining his unjust control.

For decades, corporations have placed environmentally hazardous facilities in Black and indigenous communities – leaving our communities to bear unjust levels pollution-related illnesses like asthma, emphysema, and chronic bronchitis.4

And the protests at Standing Rock ring disturbingly familiar for residents of primarily Black communities like Flint, Michigan where the emergency manager poisoned the water supply to cut costs.5 It is sickening that poor Black and indigenous people must fight for the same rights to clean air and water that white communities are eagerly granted.

These attacks on the Sioux reservation do not stand alone. Over the years, the reservation has shrunk significantly due to government intervention and corporate theft. And time and time again, the reservation has been attacked with state-sponsored massacres, where Sioux natives were mercilessly killed by members of the United States Army. These attacks on Standing Rock are not just attacks on their drinking water, but attacks on their sovereignty and way of life.

We cannot let Trump and his self-serving corporate pals erase the Standing Rock Sioux reservation and poison our air and water.

In this era of trump,we all need to be aware … listen to what he and his team says but watch and remember it’s what they do that actually matters !! I believe he will prove to Americans that his words will never match his actions and if you need proof, do the research on the people he is bringing into the White House … a cabinet of not only billionaires who know nothing about governing a free world, but white nationalist that have made it to the NSC table. In fact you have to wonder just exactly what name to put on the trump political party because based on his actions,comments and attacks he definitely doesn’t act like republican or someone from the democratic party, so your guess is as good as mine.  I am convinced it all is going to take us into a recession aka depression then ask yourself if they are there to work on your behalf or for the sake of the almighty dollar? ask: why does ivanka have to auction off #PresidentialFireSideChats for $50 – 70K, pose with a #PresidentialBraclet for $10K or provide info on a dress she may have worn at a questionable conflict of interest meeting …

I say, don’t listen to political rhetoric, TV news or pundits for the absolute truth because there are none, but remember these folks get paid to report just enough to keep you interested, some cut to the truth some or most won’t at least until the actions of this admin have progressed into behavior worthy of countries that aren’t free … at all .  If you were paying attention, trump, is now the one term official who used and continues to use every ounce of free airtime he can to spread his truth; that main stream media continues to fail voters viewers by not challenging him sufficiently.  While this admin seems to bob and weave trump is filling his swamp with folks who could very well ruin the America we used to know and still love … I said could because we have no idea what this man is capable of doing in the political arena; just the numerous reports of  bankruptcies, no official vetting, refusing to release his tax returns, stiffing workers and quite possibly procurement of large loans from folks outside of the US of A and I have gotta say …
