The Cleveland Police Department Reaches a Settlement with the Department of Justice

Memorial Day weekend has hosted several important developments in the world of criminal justice. Today, the Cleveland Police department—which has come under fire in recent months in the nationwide debate over police tactics—agreed to follow some of the strictest standards in the nation over its officers’ use of force. Cleveland agreed to the terms as part of a settlement reached with the Department of Justice over what justice officials called a “pattern of unconstitutional policing and excessive use of force.”

According to the Justice Department’s report, the Cleveland police department used stun guns inappropriately, punched and kicked unarmed people, shot at people who did not pose a threat, and failed to report or investigate most of these incidents. As a part of the settlement, Cleveland agreed to some of the most rigorous policing standards in the nation. These include:

  • Prohibiting officers from unholstering a firearm “unless the circumstances create a reasonable belief that lethal force may become necessary,” and documenting every time that occurs.
  • Banning pistol whipping, the firing of warning shots, and the use of neck holds (that pistol whipping had to be explicitly barred says enough).
  • Creating a community police commission, made up of ten representatives from around the community.
  • Allowing an independent monitor to track its progress.

The settlement comes just two days after a white Cleveland officer who fired at least 49 shots at two unarmed African Americans was acquitted of manslaughter by an Ohio judge. Officer Brelo’s acquittal—as the latest in a series of troubling racially charged incidents across the US in places like Baltimore, Staten Island, and Ferguson, MO—prompted protests that remained largely peaceful but still resulted in the arrest of 71 people.

Some bad news also came out of the criminal justice sphere this weekend. On Friday, Maryland Governor Larry Hogan vetoed three important criminal justice reform bills. In addition to vetoing a bill to limit civil asset forfeiture, and a bill to remove the penalty for marijuana paraphernalia, Hogan also vetoed a felon re-enfranchisement bill that would have restored voting rights to 60,000 ex-felons. Restoring access to the ballot for ex-felons is a priority in the criminal justice reform community and Hogan’s veto will serve as an important test to see whether reform advocates will show that choices like Hogan’s can have political repercussions.

BOTTOM LINE: Agreements like the one made between Cleveland and the Department of Justice have the potential to create meaningful change to a flawed system. But as Gov. Hogan’s vetoes remind us, there is much more work to be done to convince some elected officials to do their part.

#Stop&Frisk – Black History

Stop and frisk is when police “temporarily” detain somebody and pat down their outer clothing when there are specific articulate facts leading a reasonable police officer to believe a person is armed and dangerous. It is not necessary for the officer to articulate or identify a specific crime they think is being committed, only that a set of factual circumstances exist that would lead a reasonable officer to have a reasonable suspicion that criminal activity is occurring. “Reasonable suspicion” is one step below “probable cause” and one step above a hunch.

A “frisk” by definition is a type of search that requires a “lawful stop”. It is best thought of as a separate act, but in practice, a suspect who refuses to answer questions in a stop may be providing the officer with sufficient justification to frisk. A frisk should not be for anything other than a dangerous weapon or contraband. However, if other evidence, like a suspected drug container, is felt, it can be seized by the officer under the “plain feel” doctrine. The test for “plain feel” is that the item’s contraband nature be “immediately apparent”.

It took just one letter from an angry parent to convince a North Carolina school district to remove Ralph Ellison‘s Invisible Man from school libraries in the county. A short board meeting prompted by a single letter — describing one of the most significant pieces of Black literature in American history as “filthy” — was all that five members of the Randolph County Board of Education needed to feel justified in voting to ban the novel last week.1 It’s just the kind of quiet injustice — and officially-sanctioned bias — that happens behind closed doors in towns across the country all of the time. But this time, we have an opportunity to push back.

Just days after Randolph’s decision made national headlines, the school board called an emergency special meeting for tonight regarding the ban.2 If a couple of bad press hits is enough to make Randolph reconsider, imagine how powerful thousands of our voices can be.

The Board is meeting TONIGHT. Will you join us in demanding that the school board reverse its decision and return Invisible Man to library shelves? It only takes a moment.

This isn’t the first time in recent months that books by Black authors depicting American racism have been attacked. Earlier this month, the president of the Ohio Board of Education called Toni Morrison‘s The Bluest Eye “pornographic.”3 And in July, a Detroit-area school district came under fire for dumping a collection of over 10,000 volumes of invaluable Black books and artifacts.4 Enough is enough.

Banning Black stories not only alienates Black students, it denies all students the opportunity to engage with and discuss important themes like racial enmity in society and the development of personal identity. For elected officials concerned with the education of our young people, it’s particularly perverse that Randolph’s school board failed to recognize the irony of banning a book that’s about silencing critical voices and the ways in which racist culture restricts individuals from reaching their full human potential.

Please join us in calling on the Randolph County school board to reverse its book ban at tonight’s meeting. Together we can send a message about the critical value of Black literature in our schools.

The Rescue of the Auto Industry — By the Numbers

At the height of the financial crisis, some people, including Mitt Romney, said we should “let Detroit go bankrupt.” And Bain Capital was one of the many private investors that refused to invest in the auto industry when it stood on the brink of collapse.

Fortunately, President Obama saved the U.S. auto industry and now it’s roaring back. For example, just today we learned that General Motors is adding another 2,000 jobs in Michigan. These jobs are coming to Michigan as part of larger effort to insource thousands of jobs at the world’s largest automaker.

And this is just the tip of the iceberg. Here’s a look at the auto rescue — by the numbers.

  • More than 1 million: Jobs saved by the auto rescue.
  • $85 billion: Totalspent by the U.S. government on the auto rescue.
  • $60 billion: Amount the government will likely recover.
  • $7.2 billion: Savings to taxpayers from reducedunemployment, Social Security, and other benefits in 2009 and 2010.
  • $97 billion: Estimated losses in personal incomes prevented by the auto rescue.
  • 26 percent:Remaining stake (of the initial 61 percent stake) held in GM by the government.
  • 0: Number of Chrysler shares currently held by the government.
  • 167,000: Number of jobs the automakers and their suppliers are forecasted to add by 2015.
  • 2.5 million: Number of people employed by the U.S. auto industry today, up from 2.3 million in August 2009.
  • 3.3 million: Cars and light trucks sold by GM and Chrysler in the past 12 months, up from 2.9 million in the previous period.

BOTTOM LINE: Mitt Romney said to “let Detroit go bankrupt,” but we didn’t do that and now the auto industry is helping to fuel the recovery in states across the country, particularly Michigan and Ohio.

President Obama held a grassroots event in Denver, Colorado where he highlighted how health reform has helped women get access to the care they need.

-Over 868,600 women will now have access to free preventive care.  That means things like mammograms, screenings for cervical cancer and pap smears are available to women without any cost-sharing.
